To Whom It May Concern:

Pursuant to the California Public Records Act, I hereby request the following records:

Emails, letters, and memos to or from police/law enforcement unions, the National Guard, or federal officials between May 1, 2020 and the present.

I also request copies of emails containing any of the following: "protest", "protests", "Black Lives Matter", "BLM", "riot", "riots", "antifa", "antifascist", "anti-fascist", or "militia".

I am a member of the news media and request classification as such. I have previously written about the government and its activities, with some reaching over 100,000 readers in outlets such as Gizmodo, MuckRock, Motherboard, Property of the People, Unicorn Riot, and The Outline, among others. As such, as I have a reasonable expectation of publication and my editorial and writing skills are well established. In addition, I discuss and comment on the files online and make them available through non-profits such as the library Internet Archive and the journalist non-profit MuckRock, disseminating them to a large audience. While my research is not limited to this, a great deal of it, including this, focuses on the activities and attitudes of the government itself. As such, it is not necessary for me to demonstrate the relevance of this particular subject in advance.

As my primary purpose is to inform about government activities by reporting on it and making the raw data available, I request that fees be waived.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

The San Bernardino County Sheriff’s Department (“Department”) has concluded its review of the Public Records Act request wherein you seek: Emails, letters, and memos to or from police/law enforcement unions, the National Guard, or federal officials between May 1, 2020 and the present; and copies of emails containing any of the following: "protest", "protests", "Black Lives Matter", "BLM", "riot", "riots", "antifa", "antifascist", "anti-fascist", or "militia".

 

Some of the records you have requested contain confidential information and/or communications exempt from Public Records Act disclosure. Your request includes within its scope records covered by the deliberative process privilege. This privilege is based on the policy of protecting decision-making process, and the recognition that public officials need to have access to a range of opinions and points of views and to discuss matters in confidence before making decisions or taking action. (Times Mirror Co. v. Superior Court (1991) 53 Cal.3d 1325, 1344-1346; Cal. First Amendment Coalition v. Superior Court (1998) 67 Cal.App.4th 159, 171-172; Rogers v. Superior Court (1993) 19 Cal.App.4th 469.)

Finally, investigative records are confidential and exempt from Public Records Act disclosure. Government Code section 6254(f) exempts from disclosure “any investigatory…files compiled by any…local agency for…law enforcement…purposes.” These records are exempt from disclosure, whether or not the prospect of enforcement proceedings is concrete and definite (Haynie v. Superior Court (2001) 26 Cal. 4th 1061, 1069; Black Panther Party v. Kehoe (1974) 42 Cal.App.3d645, 654; Younger v. Berkeley City Council (1st Dist. 1975) 45 Cal.App.34 825, 833; American Civil Liberties Union Foundation v. Deukmejian (1982) 32 Cal.3d 440), and remain protected from disclosure, even after an investigation has concluded. (Williams v. Superior Court (1993) 5 Cal.5 4th 337, 355-362.)

 

For the reasons outlined above, your request is denied.
