Pursuant to the Texas Public Information Act , I hereby request the following records:

Copies of the "Equitable Sharing Agreement and Certification" forms submitted for the years 2009-2013 to the Department of Justice. The DOJ requires any law enforcement agency that participates in its equitable sharing program for asset forfeiture proceeds to submit these forms on an annual basis.

I request that all fees be waived first and foremost because I am a journalist -- employed by MuckRock and the Boston Globe -- and intend to use any pertinent information I receive as a result of this request to educate the public on the DOJ's equitable sharing program.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

We have received your Public Information Act request, and are in the process of reviewing our records.  In the interest of getting the records you want to you as promptly and efficiently as possible, I have two questions:
The types of lawsuits can include cases filed by SAPD, as well as cases filed against SAPD including use of force, employment, vehicle collisions and a variety of other claims.  Do you want all of these cases, or just certain types of cases? 1. The Public Information Act requires that requests be liberally construed.  I believe you want a comprehensive list of cases, but the request could be construed to include all the pleadings filed in a case, as well as documents that contain attorney work product.  If the request includes pleadings, the volume and cost will go up dramatically, and if the request includes documents that contain attorney work product the request will be sent by the city to the Texas Attorney General’s Office for a ruling.  The city does maintain a database that includes all lawsuits filed by and against the San Antonio Police Department, so if this is what you want, if you will affirm this request, or make any other clarifications in response to this email, we will begin to assemble the responsive records. 2.
The Texas Public Information Act requires that all requests for clarification, when the requestor includes a mailing address as part of the request, be sent by certified mail to the listed mailing address.  If I do not receive a response to this email by 1:00 p.m. tomorrow, I will send a request for clarification by certified mail.  Prior to your receipt of any such letter, however, we will continue to work with you in an attempt to provide the requested records as promptly as possible. Thank you for reaching out to me regarding your questions. I am only seeking a list of the lawsuits, not any of the court documents themselves. I'm not sure how San Antonio's system is constructed, but other city attorneys offices I made the same request to were able to segregate the cases down to the type of lawsuit, and also provide the amounts of any settlements or judgments in the cases. If that is possible, I would ideally like a list of only civil rights and tort lawsuits filed against the police department since 2009. If that's not possible within your system, a complete list of civil lawsuits filed against the police department would be just fine.
