Pursuant to the Virginia Freedom of Information Act, I hereby request the following records:

- A copy of the notice delivered to tenants whose payments were late (blue paper)
- Any spreadsheets, logs or records relating to evictions created between Jan. 1, 2019 and the time this request is processed
- A copy of the eviction procedures and policies currently in effect
- All emails or requests to address the Board received by RRHA between Sept. 1 2019 and the time this request is processed

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Richmond Redevelopment and Housing Authority (RRHA) acknowledges receipt of your FOIA request, dated November 11, 2019 received on November 13, 2019.

Upon further review a response will be provided to you within 5 business days of your initial request date. Day 1 is considered the day after your request is received. The five-day period does not include weekends or holidays.

If it is not practically possible to identify, locate, or provide the records you requested within 5 business days, RRHA may require an additional 7 days to respond to your request pursuant to Va. Code § 2.2-3704(B)(4).

Mr. Nash,

Thank you for your inquiry. In your FOIA request received by RRHA on 11/12/19, you requested the following records:

(1) A copy of the notice delivered to tenants whose payments were late (blue paper)
(2) Any spreadsheets, logs or records relating to evictions created between Jan. 1, 2019 and the time this request is processed
(3) A copy of the eviction procedures and policies currently in effect
(4) All emails or requests to address the Board received by RRHA between Sept. 1 2019 and the time this request is processed
RRHA can provide the following responses to your specific inquiries:

(1) We are not familiar with the record you requested. To the best of our staff's knowledge, we do not issue any form of tenant notice on blue paper. Are you requesting a copy of the "pay-or-quit" notice which is issued to RRHA tenants in typical months when payment is late? If so, please specify the timeframe or community for which you would like to review the records.

(2) RRHA property management staff retains manual paper copies of all relevant lease enforcement documents. These records are maintained separately by each management office. Each record also contains sensitive tenant information which RRHA may not disclose pursuant to the Federal Privacy Act, 5 U.S.C. § 552a et seq. Compiling and appropriately redacting this information would require significant manual manipulation of RRHA's physical files. RRHA can provide these records; however, in doing so, RRHA reserves its right, pursuant to Va. Code § 2.2-3704(F), to charge for its actual costs in compiling and producing the requested documents. RRHA's costs will be calculated based on the actual rate of pay, exclusive of taxes and benefits, for the lowest-paid employee qualified to handle the necessary records. Please advise if you consent to be charged for this service.

(3) The only written policies which RRHA observes in relation to lease enforcement and evictions is the Dwelling Lease and its Admissions and Continued Occupancy Policy (or "ACOP"). There are currently two versions of RRHA's Dwelling Lease in circulation-the 2018 version, which is most current, and the 2010 version, which is being phased out, but is still in effect for certain tenants. Both are attached. Also attached are Chapters 21 and 22 of the ACOP, which deal with lease enforcement and eviction, respectively. Please be further advised that RRHA proposed revisions to Chapters 21 and 22 of the ACOP, but those revisions will not take effect until HUD approves RRHA's pending Annual Plan submission.

(4) Summaries of all such citizen requests for the September, October, and November Board meetings are attached.
