From: Peter Dennehy

Dear Shawn Musgrave:
On April 29, 2014 you sent an email to the State Controller at the RI
Department of Administration, in which you requested “Contracts for the
ten (10) employees with the highest salaries”
Your request was submitted pursuant to the Access to Public Records Act
contained in RIGL section 38-2-1 et seq. (“Act”), and I have been asked
to respond on behalf of the RI Department of Administration
(“Department”).
In response to a request for records, an agency such as the Department
is required to make available for public disclosure those records that
are responsive to a request, are in the possession of the agency and are
not otherwise exempted from disclosure by the Act. Moreover, the Act
states in section 38-2-3 (h) as follows: Nothing in this section shall
be construed as requiring a public body to reorganize, consolidate, or
compile data not maintained by the public body in the form requested at
the time the request to inspect the public records was made except to
the extent that such records are in an electronic format and the public
body would not be unduly burdened in providing such data.
Your request is unclear. As such, it has been interpreted to refer to
“employment contracts”. As you may not be aware, most state
employees have not entered into such contracts. In response to your
request, as we have interpreted it, I have been informed that
Department does not maintain in any format a record which contains
“Contracts for the ten (10) employees with the highest salaries”.
While we do not possess or maintain the record that you seek, you may
wish review the information contained in the State Transparency Portal.
The Portal may be accessed at www.transparency.ri.gov/
Yours truly, Peter Dennehy
