Dear Mr. Koebler:

Your Access to Public Records Act ("APRA") request to the Department of Revenue, Division of Motor Vehicles ("DMV") dated October 16, 2023, has been referred to me for response. In your message of October 16, 2023, you indicated that your request is a follow-up to an earlier one dated July 31, 2023. The DMV has no record of your earlier request, however, and your October 16th correspondence was actually located in the junk e-mail folder of the individual who is the former legal counsel at the DMV. Pursuant to R.I.G.L. §§ 38-2-3(e) and 38-2-7(a), the DMV is responding to your APRA request within ten (10) business days of receipt of your request. Per your instructions, this response is being provided via email to: requests@muckrock.com<mailto:requests@muckrock.com>.

I have consulted with the appropriate DMV personnel regarding your request for the following records:

"- Any incident reports, consumer complaints, or investigation reports about Tesla battery range filed in the calendar year 2023 (Include all attachments, emails, recordings, and photos, if applicable)"

The DMV does not maintain any records responsive to your request.

Please be advised that R.I.G.L. § 38-2-8 provides, inter alia, that a person or entity denied the right to inspect a record of a public body may petition the chief administrative officer of that public body (for DMV: Thomas A. Verdi, Director, Department of Revenue) for a review of determinations made by his or her subordinate, may file a complaint with the Department of Attorney General, or institute proceedings for injunctive or declaratory relief in the Superior Court of the county where the record(s) are maintained.

Sincerely,

Roger R. Demers, Esq.
