Hello,

Due to the active court case, no call for service was given. This can only be released once the court proceedings are complete.

Thank you for your response! I'm a little confused by it, though, I'm afraid.

Your response says: "To view your Public Record Request, you can use the following link Public Record Request (https://reno.streamlinegov.us/PublicRecordRequest/Detail?caseId=48720) "
I created an account on that site and logged in, but the only message I see is "no records found."

Further, I believe the law requires a more complete explanation for rejecting my request, under NRS 239.0107 1(d)(2): "a citation to the specific statute or other legal authority that makes the public book or record, or a part thereof, confidential."

The 2/20/2024 response you sent states that the records will not be released because of "Donrey of Nevada v. Bradshaw ((106 Nev. 630, 798 P.2d 144 (1990))" and "Personal Information (NRS239B.030 / 603A.040)"

Donrey is a case that set out a judicial balancing test for weighing the public policy considerations of releasing versus withholding certain records. It isn't, in and of itself, a justification for withholding specific records. Please explain the balance you struck in this specific instance: Why does public policy justify withholding rather than releasing the records I requested?

NRS239B.030 / 603A.040 are lengthy and multifaceted statutes pertaining to personal information held by government agencies. Can you please explain precisely what in those statutes justifies withholding the records I requested?

In your 2/21/2024 response, you stated "Due to the active court case, no call for service was given." Can you please specify what Nevada law requires withholding calls for service when court cases are active?

Finally, just to be clear: There are zero records related to the incident at the Starbucks located at West 7th St and Keystone Ave, at approximately 7:45 a.m. on Saturday, Feb. 17, 2024 that can be made public? I'm hoping you can clarify based on NRS 239.0107 1(c)(2)' s requirement that entities "make a reasonable effort to assist the requester to focus the request in such a manner as to maximize the likelihood the requester will be able to inspect, copy or receive a copy of the public book or record as expeditiously as possible."

Thanks for your help, I appreciate that public records work isn't straightforward or easy.
