Pursuant to the Virginia Freedom of Information Act, I hereby request the following records:

- A copy of any data release consent forms parents or students are asked to sign
- Any current policy documents or guidelines governing student data usage
- Any amendments made to those forms from 2015-2019
- Documents outlining any third-party programs or applications collecting student data

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Per Virginia Code Section 2.2-3704 (A) of The Virginia Freedom of Information Act which states that "all public records shall be open to inspection and copying by any citizens of the Commonwealth," your request is denied based on your mailing address in Somerville, MA. The Act only provides Virginia citizens, representatives of newspapers and magazines with a circulation in the Commonwealth, and representatives of radio and television stations broadcasting in or into the Commonwealth with access to the records of public bodies."

The School Division received your Freedom of Information Act (FOIA) request and your follow-up email providing your Virginia mailing address on February 19, 2020. We are providing this response consistent with Virginia Code § 2.2­-3704.

The responsive documents to request #1 (A copy of any data release consent forms parents or students are asked to sign) and request #2 (Any current policy documents or guidelines governing student data usage) are attached and there is no charge, as it required less than 15 minutes of staff time to compile. For request #1, the Division is providing all forms that are collected through central offices. Consent forms may be created by other school sites. Please advise if you wish to expand the scope of your request to include an inquiry to all 96 schools.

An advance determination indicates that the production of the records requested in request #3 (Any amendments made to those forms from 2015-2019) and request #4 (Documents outlining any third-party programs or applications collecting student data) would require at least 11 hours of staff time, at a minimum cost of $466.52. The calculation of charges is provided below.

Due to the scope of your request, it is not practically possible to provide the requested information for request #3 and request #4 within the five (5) working day period. Ergo, the School Division invokes an additional seven (7) working days in which to respond to your request as provided by Virginia Code § 2.2-3074 (A)(4).

Please notify us immediately if you wish to proceed with this portion of your request. The timeline for our response is tolled until we receive your notification.
