To Whom It May Concern:

Pursuant to the Oregon Public Records Law, I hereby request any lists or databases regarding the credibilty of police officers. Such lists are common in many jurisdictions, and go by names such as "Giglio lists," "Brady lists," "bad cop lists," "police credibility lists," or "do not call lists." Please provide the list in its entirety, which should include, at a minimum, the name of each officer on the list, and information about why the officer is on the list.

Furthermore, I am requesting any other records that refer to or discuss said lists, such as policies regarding when or how officers are added to the lists, when and how officers are removed, and how the lists are used.

The Multnomah County District Attorney's Office does not maintain a so-called "Brady" list. Attached is the current list of names of officers who are included in our Potential Impeachment Disclosure (PID) Index. The PID Index contains materials that may be necessary to disclose to defense counsel concerning certain officers in certain cases. This is not, and should not be interpreted as, a list of officers who will not be called to testify. I have also attached a copy of our current Policy Manual. The policy concerning the PID Index is discussed on pages 28 through 34.

Attached is a PDF of the Names in the PID, as well as the specific pages of MCDA's Policy Manuel that addresses the PID Index, and the PIDMemos.

As I stated in my previous email to you, the Multnomah County District Attorney's Office does not maintain a "Brady List" nor do we maintain a list of officers about whom we have credibility concerns. Rather, as explained in more detail in the attached policy, we maintain an index of potentially impeachable material as to government witnesses.

Please understand that the fact that a witness appears in this index does not mean that that person will not be called as a witness and does not necessarily mean that this office has concerns about his or her credibility (though we may in some cases as the attached memos indicate). Rather, inclusion in the PID index only means that there is information about that person that we may be legally required to produce to opposing counsel in particular cases.
