RE: City Public Records Request of April 30, 2018 Reference # C067952-043018

Dear Taylor,

The City received a Public Records Request from you on April 30, 2018 for the following:
"Pursuant to the Oregon Public Records Law, I hereby request the following records:I would like to obtain all emails sent to, from, or copied to Charlie Hales, former Mayor from January 1, 2015 to Present day, containing any of the following non-case-sensitive key-strings: 'EB-5', 'Regional Center', 'USCIS' or 'EB5'.The requested documents will be made available to the general public, and this request is not being made for commercial purposes.In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would request your response within ten (10) business days.Sincerely,Taylor S. Amarel[original email attached]"

You have requested a fee waiver from the City of Portland for the fees associated with your public records request.  Your request is complicated enough to require me to complete a cost estimate according to statute.  I want to give you an opportunity to provide more information related to your waiver request while I prepare my estimate.  Please provide the following information to help me evaluate your fee waiver request:

1) How do you or your organization intend to use the information?  (Please answer regarding the specific information requested as opposed to speaking generally regarding information on the general topic requested);

2) How will the information benefit the wider public?  (Please explain how this specific information assists the public given the information already provided to the public on this topic);

3) How do you or your organization intend to disseminate the information to the wider public?
Without responses to all 3 of these questions it may be difficult, or even impossible, to assess whether the requested disclosure is in the public interest because it will primarily benefit the public.
Please also bear in mind that the Bureau providing the records must weigh the public's interest in disclosure against the cost to the public of fulfilling the request without reimbursement.  As part of that balancing of interests, the City may consider the volume of the records requested.  Please discuss whether a more narrowly tailored, and thus less expensive, request could equally meet the public interest.
Sincerely,

JEN CLODIUS

This email serves as our cost estimate on your public records request.  Before proceeding, please confirm the following search criteria:
We are searching the following locations: Email (Includes archives) of these individuals: (former mayor) Charlie Hales for the following search terms: EB-5 OR Regional Center OR USCIS OR EB5 (requester assumes search is not case sensitive) and date range: 01/01/2015 to 04/30/2018.  If this search is incorrect or you would like to make any changes, please notify us immediately.

If we do not hear from you, we will proceed along these parameters.

The City may be the custodian of at least some of the requested public records and the estimated fees are $118.21. Approximately 10 business days after the deposit is paid, the records will be ready. However, they will not be provided until the final amount is paid. If the final amount incurred is less than the estimate, you will only be charged actual costs.  If the work significantly exceeds the estimate, the City will contact you with a new estimate. By paying the 50% deposit of $59.11, you are confirming this estimate and agreeing to pay the cost of fulfilling this public records request according to the conditions set forth by the City.  The costs may include the cost of locating records, reviewing records to redact exempt material, supervising the inspection of records, copying records, certifying records and mailing records, including the cost of searching for records.  We will not be working on your request until we receive the 50% deposit.
Please note that while -- depending on your response to the questions emailed earlier today -- I may be able to waive fees for my time, I cannot waive fees for the email search itself. That email search is the source of the $118.21 estimate.

Please reply to this message or log in to the Portland Public Records Request Center and indicate that you agree to pay the estimate.  You may pay by electronic check or credit card by going to "My Public Records Request Center" and select "View My Payments".  Then scroll to find an invoice in the status of "payment pending" and select "Make Payment".  Follow the screen prompts to make a payment.  Alternatively, you may mail a check made payable to "The City of Portland".  Please be sure and provide the Record Request Reference number (C067952-043018) on your check and mail it to:

We would like to clarify with you what records you are seeking.  Please reply to this message or log in to the Portland Public Records Request Center to update this request.  Specifically,
"regional center" was one of the search terms you specified. Based on your other search terms, I am assuming that you're looking for email relating to immigration issues. Is that correct? I've just gotten back the results of the email search, and am finding hits for "Tanasbourne/Amberglen Regional Center" (which is a planning area in a neighborhood), "Metro Regional Center" (which is home of the Portland Metro area's governing body), "Gateway Regional Center" (which is a transportation hub), and the like. Please confirm that you are looking for immigration-related email.
Please respond within 10 days of this email.  Thank you.

File 19 wasn't exempt from disclosure; it was non-responsive. It was a meeting notice about transportation, and was held at the Metro Regional Center. It got pulled in the search because it hit "regional center" and I missed it when I did my first pass of deletions.
