To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:

All controlled substance seizure reports from January 1, 2006 to the date that this request is processed.

The documents I am requesting are referenced here (http://www.sec.state.ma.us/arc/arcpdf/MA_Municipal_Records_Retention_Manual.pdf) under the heading "Police Department" item 16.014.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Sincerely,

George LeVines

Sir,

We have received your fax request for all controlled substance seizure reports from January 1, 2006 to this date.

This is our first receipt of your request, even though the document references older dates.

There is a fee for research, redacting non-public information, copying, postage and media payable by check prior to producing the record. Estimated fees for longer reports are based on the number of pages, special media, and the time for an employee, records clerk, computer specialist, officer, investigator, or supervisor to produce the record.

The estimated time to produce these reports is 40 hours at $45 per hour.

Payment is due before the record search. Please mail a check or money order payable to the Pittsfield Police Department. The fee for the requested report is estimated to be $1800.00

Some of the records you seek may be denied pursuant to MGL Ch 4 Sec 7. In accordance with 950 CMR 32.00 this decision may be appealed to the Supervisor of Records, Office of the State Secretary, One Ashburton Place, room 1719, Boston MA 02108. (617)727-2832.
