Written requests for records to state and local agencies in Pennsylvania are generally governed by the Commonwealth’s Right-to-Know Law (RTKL), 65 P.S. §§ 67.101-67.3104. In accordance with the RTKL, the City has promulgated an Open Records Policy, which requires the standard statewide Right-to-Know Form be used for the submission of written requests pursuant to the RTKL. See 65 P.S. § 67.504(a); Dekok v. Lancaster County, AP 2010-1197, 2011 PA O.O.R.D. LEXIS 25 at *5 and n.1 (Pa. O.O.R. On February 13, 2024, the City  received your request for: "- Any and all written or electronic communications, including attachments, between your department and members of USA Pickleball, (@usapickleball.org). This request seeks documents created between January 1, 2020 and the date this request is processed. - Any emailed or formal complaints containing the word "pickleball." Please search between January 1 and the time this request is processed." On February 23, 2024, the City asserted its right to a 30 calendar day extension to respond to your request. This correspondence constitutes the City's final response to your request. ​ Your request is denied.  The Office of Open Records has previously held less expansive requests insufficiently specific. See Dennis v. Conneaut School District 2022 WL 1982982 (Pa.Off.Open Rec.), 5. Citing Calefati v. Phila. Sch. Dist., “the OOR found that an RTKL request seeking emails exchanged by eleven identified staff containing one of fourteen keywords, including several last names, over the course of a year was insufficiently specific because the timeframe was too long to support the vague keywords and large scope of the request.” OOR Dkt. AP 2019-1289, 2019 PA. O.O.R.D. ​ Please also not that records reflecting “complaints submitted to an agency” in connection with noncriminal investigations are expressly exempt from the disclosure requirements of the Act.  65 P.S. § 67.708(b)(17)(i).  Your request is further denied to the extent the records requested are otherwise exempt as material relating to noncriminal investigations pursuant to 65 P.S. § 67.708(b)(17), as well as to the extent the records requested reflect and/or contain personally identifying information pursuant to 65 P.S. § 67.708(b)(6)(i)(A), including the home addresses of individuals.   This correspondence will close your request with our office as permitted by law.
