Pursuant to the New York Freedom of Information Law, I hereby request the following records:

Provide the Pelham Village Code for On-Street Overnight Parking in Pelham.

Provide all On-Street Overnight Parking records including all records of summonses (dismissed/and reason for dismissal/paid) issued for New York State license plate numbers HLN5632 and JKB2295 from years 2009 through present (2023). Include all dates and times Pelham Police Department createwas notified for said vehicles to park On-Street Overnight, and individuals who authorized the On-Street Overnight Parking for vehicles HLN5632 and JKB2295.

Provide all explanations for each and every On-Street Overnight Parking request that was granted by the Pelham Police Department on why registered owners of New York State license plate numbers HLN5632 and JKB2295 neither has or can create adequate, accessible parking at the location where he or she must park on-street overnight.

What specific address is given for vehicles HLN5632 and JKB2295 to the Pelham Police Department to be allowed to park On-Street Overnight. Include all dates from 2006 to present (2023).

Provide a copy a a HOPE permit which according to Village of Pelham Code 90-16, "Must be displayed conspicuously in the vehicle so that it is easily visible through the front windshield".

Provide all Pelham Police Department procedures on how/why a vehicle is allowed to park On-Street Overnight in Pelham, to include if a cut-off time exists.

Provide all HOPE application records from 2006 through present (2023) for New York State license plate numbers HLN5632 and JKB2295 in addition to all vehicles registered to or associated with all residents located on First Avenue between Fifth and Sixth Streets.

Provide all rules, regulations, documentation, on how many times per year a vehicle is allowed to park On-Street Overnight when owner of vehicle has adequate parking to park vehicle(s) in their own driveway, and vehicle(s) is/are functioning to include all reasons why and why not a vehicle is allowed or not allowed to park On-Street Overnight in Pelham, NY.

Provide all locations (according to Village of Pelham Code 90-16, Section B, #1) stating "All-night parking of passenger vehicles is permitted at those locations which the Village Board of Trustees has specifically authorized for that purpose", and for what purpose(s).

Provide all vehicle information to include all applications from 2006 through present that hold or held a valid permanent or temporary handicapped parking permit issued by the Town of Pelham pursuant to 1203-a of the Vehicle and Traffic Law of New York State for vehicles registered to addresses located on First Ave, between Fifth and Sixth Streets, in Pelham, NY.

Provide all On-Street Overnight Parking summonses including all other parking offenses for all vehicles parked on First Ave, between Fifth and Sixth Streets from 2006 to present (2023). Include all license plate numbers and dispositions of summonses.

As described in the New York Freedom of Information Law, a record is "any information kept, held, filed, produced or reproduced by, with or for an agency or the state legislature, in any physical form whatsoever including, but not limited to, reports, statements, examinations, memoranda, opinions, folders, files, books, manuals, pamphlets, forms, papers, designs, drawings, maps, photos, letters, microfilms, computer tapes or discs, rules, regulations or codes." Records kept in a digital or electronic form are also records, would be responsive to this request, and should be provided.

Pursuant to NYCRR Section 1401.5(c)(1), should any of this request be unclear or lack sufficient description for your office, please provide direction that would enable this requester to request records reasonably described. Please also note that the New York FOIL states: "An agency shall not deny a request on the basis that the request is voluminous or that locating or reviewing the requested records or providing the requested copies is burdensome because the agency lacks sufficient staffing or on any other basis if the agency may engage an outside professional service to provide copying, programming or other services required to provide the copy...." The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

Dear Mr. Pappalardi,

Please see the attached and below to satisfy your FOIL request.

* Attached is a copy of the Village Code regarding On-Street overnight parking.

* Attached are the two parking records we have for those specific plates asked for in our VO-56 parking system. We do not have explanations for these particular permissions. Those are verbal requests that each individual desk officer has discretion over at the time of the request. Records from 2016 – Present are attached; prior records do not exist.

* The addresses given are on the attachments and appear to all be 448 First Avenue.

* Attached is a copy of a sample HOPE hanging tag permit.

* We do not have a formal written policy on overnight parking permission. It is against the law to park overnight from 2-6am and we as a police department grant certain verbal permissions with a phone call to our desk for various types of hardships village wide.

* Attached under file “Pappalardi FOIL – HOPE” are the requested HOPE applications. The specific license plates you indicated have no record of application. Records from 2009- Present are attached; prior records do not exist.

* “Provide all locations (according to Village of Pelham Code 90-16, Section B, #1) stating "All-night parking of passenger vehicles is permitted at those locations which the Village Board of Trustees has specifically authorized for that purpose", and for what purpose(s). “In regard to this request, This does not exist.

* The Village of Pelham does not have jurisdiction over Handicap Parking Permits; The Town of Pelham has jurisdiction regarding this.

* We cannot look up parking summonses particularly those written in the past with respect to a specific location like "First Avenue". Unless a particular parking lot or zone is noted on the Passport parking system (where village lots or meters exist) we can only look up summonses by the plate number. If you would like to obtain this information, please provide specific plate numbers for the request.
