The requested documents will be made available to the general public, and this request is being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I am responding to your public records request. We have broken our
response to your request for student records and employee records in to two
sections below.

*Student records*

Please see the attached document (student tab) for student names and their
programs. This list does not include students that have opted out of the
release of “directory information.” Your request for student phone numbers
is denied because the University’s definition of directory information

does not include phone numbers. Accordingly, they are FERPA protected. Your
request for student email addresses is denied as they do not meet the
definition of a public record. For example, email addresses do not serve to
document the organization, functions, policies, decisions, procedures,
operations, or other activities of Miami University. The Ohio Supreme Court
has noted that “disclosure [of non-records] would not help to monitor the
conduct of state government. In point of fact the Supreme Court of Ohio has
ruled that addresses are not public records. See *Dispatch v. Johnson,* 106
Ohio St. 3d 160 (2005).

*Employee records*

The tab titled “Faculty and Staff” contains a list of employee names,
position titles, and department. Please be aware that graduate students and
student workers are not included in this list as student employment is
protected by FERPA. We do not have a report that contains employee phone
numbers and Ohio’s public records law does not require that we create one
for you. Your request for employee email addresses is denied for the
reasons identified above.

Finally, please be advised that while the University no longer publishes a
physical directory that contains all the information that you have
requested you may use the University’s online directory at www.miamioh.edu.
Because you requested the University assigned email addresses of students
and employees, it is important for you to note that Miami University’s
network was developed and is maintained for the benefit of our students,
faculty, and staff. Miami’s computing services are reserved for the
support of our instruction, research, and service missions; student and
campus life activities; and University administrative services. Miami’s
email system is not available for external commercial solicitation. We
fully expect you to comply with all applicable laws including CAN-SPAM.
