Pursuant to the Oregon Public Records Law, I hereby request the following records:

1) All reports regarding Work Opportunity Tax Credits certified in 2019 and 2020 provided to the US Department of Labor, including forms 9058.
2) Any database tracking Work Opportunity Tax Credit certifications which is created or maintained by your department or by any third party vendor under contract with your department, preferably in .csv or .xlsx format. If it is easier, the database can be limited to the calendar or fiscal years ending in 2018, 2019 and 2020.
3) The most recent of any contracts with third party vendors to track WOTC certifications.

My goal is to ascertain which businesses and industries are applying for and/or receiving Work Opportunity Tax Credits, for which categories of employees and which occupations. If a conversation could help narrow or expedite the completion of this request, I am available at 802 233 4992 and emily_corwin@harvard.edu.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Hi Patty,

Yes -- what I mean by "most recent" is simply that I need only the currently applicable contract, in case your department has switched vendors or updated your contract with an outside vendor providing WOTC database management in the past. Of course, if your department manages your own WOTC data, this request isn't applicable at all.

Request #1: We are referring you to the ETA WOTC Performance page<https://www.dol.gov/agencies/eta/wotc/performance>. WOTC performance data reports are available to the general public for download, including tables for an overview of WOTC annual performance, wage, and occupational data. If there are additional years that are not available on the webpage, a FOIA request can be submitted to the US Department of Labor.

Request #2: The WOTC database is not subject to public records.
Request #3. Attached is our third-party vendor contract. Redactions have been made and they include phones numbers, the list of specific equipment used in designing the system on page 9 of Exhibit D/Proposal, and W-9 information that was included in the pdf document. The W-9 information was mistakenly included with this contract and was a different contractorโ€™s W-9.

For item #1 -- I am familiar with the USDOL's performance reports. Unfortunately, they lack the level of detail I am looking for. I'll attach an example of the forms I've received from 17 other states in response to a similar request as an example of the records I am seeking under Oregon's public records law. If Oregon's are exempt from disclosure, please cite the relevant statute.

For item #2, please also cite the statute exempting the database from disclosure under public records law. In case it is helpful, I'll share that a number of other states have provided the records I've sought by omitting data that is not of interest to me (and may contain PII), and providing an .xlsx or .pdf of a spreadsheet with most or all of the following fields for years 2018 through 2020.
