Hello,
Regarding your below Public Records Request for “…All policies…”, be advised this request is overbroad and ambiguous. State ex rel. Glasgow v. Jones, 119 Ohio St.3d 391, 2008-Ohio-4788, ¶ 19; State ex rel. Zidonis v. Columbus State Community College, 133 Ohio St.3d 122. This request does not specify and particularly describe or properly identify with clarity the actual, existing records you seek. This request does not describe specifically and particularly what records are being sought which would enable DRC to identify with reasonable clarity the records you seek. A public agency may refuse a request on the basis that it is too broad as to be vague and burdensome. Your request is simply too broad and burdensome. Your request falls outside the scope of the DRC’s obligations under the Public Records Act. Public agencies are not required to perform research or create new files in responding to such a request which is basically a request for information, not for records. To the extent you wish to clarify what specific records you seek, DRC will search for any responsive records.
You may search for “All policies related to the employment and payment of incarcerated persons under the jurisdiction of this agency” at www.drc.ohio.gov<http://www.drc.ohio.gov> click on organization tab and policies.
DRC has no records responsive to your second request.
Thank you.
