Pursuant to North Dakota Constitution, Article XI, Section 6, and the North Dakota Open Records Statute, N.D.C.C. ยง 44-04-18(1), I hereby request the following records:

A log of public records requests submitted to the Department of Commerce that lists the date of request, the requester's name, the requester's organizational affiliation, a description of the request and the date the request was filled. Ideally I would like this information for the period from 2004 to the present.

The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, and is made in the process of academic research and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I apologize for the delay in getting back to you regarding your request.

Your request was for: "A log of public records requests submitted to the Department of Commerce that lists the date of request, the requester's name, the requester's organizational affiliation, a description of the request and the date the request was filled. Ideally I would like this information for the period from 2004 to the present."

A spreadsheet is attached that contains much of this information. This information goes back to September 2009 and we do not have information compiled prior to that date. The date of each request is listed, but we have not specifically tracked the date the request was filled. In most cases, the information requested was provided by the day following the request.

Please note that North Dakota's open records law does not require people requesting information to use a specific form or even mention they are requesting information as an "open record" or "public record." Many times, someone will ask a question of a Commerce staff member and they'll respond with an answer or send them a document and won't necessarily consider it an open record request. The attached spreadsheet contains the requests that I was aware of and may not contain all of the requests that Commerce received during that time period.
