Good afternoon Greta –

This is to confirm receipt of your public records request below. I’ve been in communication with our Planning, Statistics and Information Management (PSIM) Bureau which is responsible for processing Occupational Safety and Health records requests.

We want to be as responsive as possible, while working within the functionality of our system and our existing resources. Our system does not allow us to run automated reports or searches based on specific terms. Rather, our staff would need to manually review all of our files to pull out the information you’re looking for. We’d appreciate it if you could narrow the scope of your request by:

* Identifying a specific time period for which you’re interested (for example, the previous 2 calendar years). The initial request below does not cite a time frame.
* Clarifying whether you’re interested in the full case file or simply the complaint form. We can fulfil either request; however, please note that a full case file request may require a substantially longer period of time, and may also come with a fee, depending on the number of pages applicable to the request.

Our PSIM group is working under a large backlog of requests, which are processed in the order in which they are received. Please let me know of your preferences regarding the above items, and we will be back in touch with follow up information.

Thanks,
Jennifer

Hi Jennifer,

Thank you so much for reaching out with clarifying questions, and I apologize for my delay. I appreciate your promptness. This article has now received funding from the Berkeley's 11th Hour Project, so I will likely be in touch more routinely.

I would like this request to span from January 1990 - June 2022. I would like it to involve just the complaints. I will put in a separate requests for case files, given that this could take longer.

Thank you, and please let me know if you have any questions.

Best,
Greta Moran

Hi Greta,

This is to confirm receipt of your email request below. Based on the previous emails, I understand that you are requesting all safety and health complaints filed under North Carolina Occupational Safety and Health Act by farmworkers on a tobacco farm that include any of the words: "nausea," "dizziness," "vomiting," "Green Tobacco Sickness," and "nicotine poisoning." Further, you are requesting complaint forms only for a period of January 1990 – June 2022.

I will forward your request to the Planning, Statistics and Information Management (PSIM) Bureau for processing. As I mentioned in my March email, our computer system does not allow searches based on specific terminology. Rather, our staff has to manually pull files to review the nature of the complaint. Someone in the PSIM Bureau will follow up with you directly, but please be aware that fulfilment of this request could take a significant amount of time.

Thank you,
Jennifer

Hi Jennifer,

Thank you so much. I look forward to a correspondence with PSIM Bureau. Thank you for taking the time to pull these complaints.

You can expect separate requests from me in an effort to expedite portions of this data. If there are any questions, or a way that I can simplify my request to make the records easier to identify, please let me know. You are welcome to call me at 917-405-8720.

Warmly,
Greta

Hi Greta –

Thank you for your email. I recognize that you submitted the original request on March 7; however, we did not receive a response to our clarifying questions until July 6. That is the date on which we officially began processing this request.

As I’ve mentioned in previous emails, our Planning, Statistics and Information Management Bureau is working through a significant backlog of public records requests, and this particular request requires our staff to manually pull and review every file that could possibly be applicable to the parameters you sent. Please feel free to contact Mildred Rivera (in our PSIM Bureau) if you’d like to discuss your request in more detail or provide a more narrow scope.

Thank you and I hope this is helpful,

Jennifer
