Hello,

We attempted to provide clarification for the request named above before the stated 1/26 deadline. Please see attached, and let us know if you need any further info to reopen this request.

From: City of Norfolk

--- Please respond above this line ---

Hello, Mr. Nash.
Due to the MANY difficulties of communicating with you through MuckRock's website and links to its website, we are providing the following information related to this request:
MuckRock is not a "magazine or newspaper with circulation in Virginia." It is not a radio station or broadcast station broadcasting into or out of Virginia during the regular office hours of the custodian of the requested records. Therefore, it is not entitled to the requested records under the Virginia Freedom of Information Act. (See Virginia Code 2.2-3706(A).)
As you have provided a Virginia mailing address for requester Tom Nash, we are proceeding with the request from Mr. Nash for the following records related to the March 30, 2024, performance by Chris D'Elia at the Harrison Opera House:
1) Talent and/or promoter contracts, inclusive of any artist riders;

2) Emails to, from, or cc'ing the following representatives of Mr. D'Elia between 6/1/23 and the date this request is processed:

-enrique@iconconcerts.com
-carolyn@iconconcerts.com
-cyndi@iconconcerts.com
-paul@iconconcerts.com
You have requested an estimate to be provided to you in advance. We will begin preparing that estimate.
Please note, however, that since you have not provided an email address for a Virginia resident, we will provide you with an estimate for paper copies of the requested records, to be mailed to Mr. Nash's Virginia mailing address as provided to us via your photograph of Mr. Nash's Virginia driver's license.
Additionally, please note that the charges for accessing, searching for and producing the requested records will include charges of 10 cents per page for the production of the paper copies to be mailed to Mr. Nash.
To avoid incurring this per-page fee, please provide us with Mr. Nash's direct email address. The Virginia FOIA does not require us to provide records to an email address provided by a website based in Massachusetts, as that website is not part of one of the media entities entitled to the requested records as explained above.
If you do not wish for us to proceed with the estimate of charges, please notify us promptly at: foia@norfolk.gov. Also, please note that, pursuant to the FOIA, estimated charges in excess of $200 will require advance payment of the charges before the work of producing the records begins. Heather Tierney

From: Muckrock Staff

Hello,

Tom Nash's email address is the following: [Email Redacted]

Thank you for your cooperation with this request.

From: City of Norfolk

Hello, Mr. Nash. The City of Norfolk FOIA Team provided a request for clarification to you on Jan. 29, 2024. That request for clarification asked you to provide us with a direct email address to Mr. Nash, as MuckRock is not a media entity entitled to receive the records under the Virginia Freedom of Information Act. If the only information provided to us is an email address for MuckRock, the request will be denied, as MuckRock is an out-of-state requester.

The information we sought also included this: You have provided a physical mailing address for Mr. Nash. With the physical mailing address, and in the absence of an email address for Mr. Nash, we would be compiling an estimate that includes paper copies of the records to be emailed to you.

There are approximately 400 emails to be reviewed for potential responsiveness to this request. If you wish for us to compile an estimate for you that includes copies of the printouts to be mailed to Mr. Nash’s physical address, please let us know, and we would be happy to compile that estimate, which would also include 4 hours of review time at $30.06 per hour. The cost of the copies of the paper printouts would be 10 cents per page.

Please reply to this email address (foia@norfolk.gov<mailto:foia@norfolk.gov>) to let us know whether you would like us to compile that estimate, or whether you are willing to provide us with an email address directly to Mr. Nash. If we are provided with that email address, we can, of course, provide electronic copies of the emails after they are reviewed. If you choose that option, the estimate would consist solely of the review time ($30.06 per hour for 4 hours).

Thanks very much.
