Pursuant to the New York Freedom of Information Law, I hereby request the following records:

Live Birth Data including constant birth rate, long term, short term and average birth rates for within the district for current and previous 6 years.

Birth to Kindergarten Survival Ratio used for the past 10 years by year.

Projected Kindergarten Enrollment for the past 10 years by year, and supporting data.

Any communications with NYS DOH or County DOH or other data service provider requesting, receiving or inquiring regarding live birth data, birth to kindergarten survival rate or other statistical data used for projecting enrollment.

Copies of all enrollment projections for the past 6 years and source statistical data, including but not limited to live birth data which were used to provide projected enrollment data upon which securities purchasers rely.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I hope this message finds you in good spirits. I'm just dropping a line regarding the Freedom of Information Law (FOIL) request we've been batting around since March 5, 2023.

As you might remember, I asked for a few particulars:

Live Birth Data, including the current and previous 6 years' worth of rates (constant, long term, short term, and average).
Birth to Kindergarten Survival Ratio for each of the past 10 years.
The projected Kindergarten Enrollment for each of the past 10 years, along with any supporting data.
Any chit-chat between yourselves and the NYS DOH, County DOH, or any other data service provider about live birth data, birth to kindergarten survival rate, or other statistical data used for projecting enrollment.
Copies of all enrollment projections for the past 6 years and the source data, including live birth data, which were used to provide projected enrollment data upon which securities purchasers rely.
Now, according to my trusty calendar, we've sailed past the date you kindly suggested of May 3rd for providing these records. While I'm sure this is just a small oversight, I thought I'd send a friendly reminder your way.

I understand that life at the office can sometimes be a whirlwind of paperwork and coffee cups, but it would mean the world to me if we could get back on track with this request. We want to make sure we're doing everything by the book and keeping in line with the Freedom of Information Law.

I greatly appreciate your attention to this matter and look forward to receiving the requested records. I'm sure we'll have this all wrapped up faster than you can say "shenanigans"!

I am writing to appeal the constructive denial of my Freedom of Information Law (FOIL) request, which was submitted to the Niskayuna Central School District on March 5, 2023. The request sought records related to enrollment projections source data, including live birth data, birth to kindergarten survival ratio, projected kindergarten enrollment, and communications with NYS DOH or County DOH or other data service providers regarding this data.

The District acknowledged receipt of my request on March 20, 2023, and provided an extension for the request until May 3, 2023. However, despite my follow-up communications on May 4, 2023, May 22, 2023, and June 6, 2023, I have not received any further response or the requested records.

Under the New York Freedom of Information Law, an agency is required to grant or deny access to records within twenty business days of receipt of a request. If access is not granted or denied within that time, the request is deemed to have been constructively denied, and the requester has the right to appeal.

As such, I am appealing the constructive denial of my request. I kindly ask that you review this matter and provide the requested records or a valid reason for denial under the New York Freedom of Information Law.
