To Whom It May Concern:

Pursuant to the Illinois Freedom of Information Act., I hereby request the following records:

all records created in the course of responding to or processing our June 18, 2021 FOIA requests for records regarding library business maintained in the four trustees’ (Carolyn Drblik, Joe Makula, Olivia Hanusiak, and Suzanne Schoenfeldt) private email accounts.

In its written reply to the PAC, the Library District stated, "We additionally asked all of the trustees at issue whether or not they had any responsive records to this FOIA request that would meet the City of Champaign public records exceptions for private trustee communications, and they all searched their records and stated in writing that they have no responsive records (see confidential enclosure)."

Responsive records would include email correspondence pertaining to the search and other similar records, including the enclosure the Library District submitted to the PAC (Re: Niles Maine Library District Response to FOIA Request for Review 2021-PAC-C-0999; -0102; and -0104) with its August 10, 2021 reply.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Thank you for writing to the Niles-Maine Public Library District (“Library”) with your request for information pursuant to the Illinois Freedom of Information Act, 5 ILCS 140/1 et seq. (“FOIA”). On July 20, 2022 the Library received your email in which you requested:

On behalf of the Niles-Maine Public Library District and pursuant to Section 3(e) of FOIA, the Library is extending its time to respond to your July 20, 2022 FOIA request by five (5) business days, as the request requires examination and evaluation by the Library's attorney. 5 ILCS 140/3(e)(v). The Library will respond to your FOIA request no later than August 3, 2022.

Library Response

Your request is granted in part and denied in part. Attached is the record responsive to your request. Certain records have been redacted pursuant to the below sections of FOIA:

Section 7(1)(b) of FOIA: Certain private information, as defined in Section 2(c-5) of FOIA is exempt. 5 ILCS 140/7(1)(b). Private information, as defined by FOIA, includes a person’s home address, home phone number, social security number, driver’s license number, medical records, biometric identifiers and personal financial information. 5 ILCS 140/2(c-5). Specifically, personal email addresses were redacted.

Section 7(1)(m) of FOIA: Communications between a public body and an attorney representing the public body that would not be subject to discovery in litigation and materials prepared or compiled by or for a public body in anticipation of a criminal, civil or administrative proceeding upon the request of an attorney advising the public body, and materials prepared or compiled with respect to internal audits of public bodies. Specifically, items of attorney-client privilege.

You have a right to have the partial denial of your FOIA Request reviewed by the Public Access Counselor (“PAC”) at the Office of the Illinois Attorney General. 5 ILCS 140/9.5(a). You can file your Request for Review with the PAC by writing to:
