Pursuant to the New Jersey Open Public Records Act, I hereby request the following records:

On 12/29/22 at around 4:47:28 AM EST, ShotSpotter technology detected a possible round of gunfire near 357 S Orange Ave in Newark. According to dispatch audio, officers with NPD spent more than 10 minutes investigating the incident, leaving the scene at 5:00 AM EST. I am looking for records that indicate the number of officers who responded to this incident, and, if any exist, investigative reports and body camera footage from the officers who responded.

I request that the agency provide the above records in their native digital format, where applicable (such as a CSV, Excel, or other digital data format), and transferred to me electronically.

News media status and fee waiver:

As a reporter for WIRED, I qualify as a news media requester for the purpose of fees. Further, because this request is being made for a journalistic purpose regarding a matter of public interest, I further ask that you waive any fees. This request is not primarily in the commercial interest of myself or WIRED. Additionally, please notify me of costs before taking any billable steps.

Good Morning Sir or Madam:

The Office of the Clerk of the City of Newark has assigned your attached request tracking number PD-23-1115 and forwarded it to the Department of Public Safety, Division of Police.

Government agencies properly extend OPRA's initial seven-business day deadline for good cause when the extension comes within the first seven business day deadline and provides a date certain by which the request will be filled. The requestor's consent to the extension is not necessary. Starkey v. Department of Transportation, GRC 2007-315, 2007-316, 2007-317 (2009). Rivera v. Plainfield, GRC 2009-317 (2011). Criscione v. Gutenberg, GRC 2010-68 (2010).

In order to gather the documents responsive to your requests, the OPRA unit sends your requests to the respective City Departments, which actually created, received, or retained these documents. Since the State of Emergency, crucial City Staff have retired, become sick, and work a staggered schedule, which makes the time needed to gather responsive documents far longer than usual.

This office received your request on July 6, 2023, and anticipates a response on or about September 6, 2023.
