Pursuant to the New Jersey Open Public Records Act, I hereby request the following records:

1) All emails exchanges–including incoming messages, outgoing messages, forwards, and attachments–between the department's chief/commissioner and ShotSpotter representatives since January 1, 2021. ShotSpotter representatives can be identified by searching the department's email system for addresses ending in "@shotspotter.com."

2) All emails exchanges–including incoming messages, outgoing messages, forwards, and attachments–between the department's public information and/or media relations staff members and ShotSpotter representatives since January 1, 2021. ShotSpotter representatives can be identified by searching the department's email system for addresses ending in "@shotspotter.com."

I ask that all fees be waived as I intend to use the requested records to further public understanding of government functions and not for any commercial purpose.

In the event that you choose to withhold or redact the records, I ask that you provide a detailed explanation of the statutory and/or case law upon which each rejection or redaction is based.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Good Afternoon:

The Office of the Clerk of the City of Newark has assigned your request tracking number PD-22-0763 and forwarded it to the Police Division.

On March 20, 2020, Governor Murphy signed into law P.L. 2020, c.10, which provides that OPRA’s statutory deadlines do not apply for the duration of a Governor-declared state of emergency pursuant to the Disaster Control Act (N.J.S.A. App.A.9-33 et seq.), a public health emergency under the Emergency Health Powers Act (N.J.S.A. 26:13-1 et seq.), or when a state of local disaster emergency is declared by a county or by a municipality. On March 4, 2022, Governor Murphy reinstated New Jersey's State of Emergency created pursuant to Executive Order 103 with Executive Order No. 292.

In order to gather the documents responsive to your requests, the OPRA unit sends your requests to the respective City Departments, which actually created, received, or retained these documents. Since the State of Emergency, crucial City Staff have retired, become sick, and work a staggered schedule, which makes the time needed to gather responsive documents far longer than usual.

This Office received your request on May 13, 2022, and anticipates a police response by June 14, 2022.

Good morning,

Please be advised that the Office of Information Technology has concluded their search for records using the parameters in accordance to your request. The email search has produced a total of 488,890 items (emails, calendar events, etc.). Please be advised that based on the query/criteria, some emails captured may not pertain to the subject matter.

Whenever a records custodian asserts that fulfilling an OPRA records request requires an "extraordinary" expenditure of time and effort, a special service charge may be warranted pursuant to N.J.S.A. 47:1A-5.c. In accordance to this regulation, the cost to review the aforementioned number of emails at the unit of 100 emails reviewed per hour and an hourly rate of $45.00 per hour, Counsel reviewing the emails, the total cost is $220,000.50 Our office is reaching out to advise you prior to proceeding with this request, for your disposition on approval of the same. Upon approval, a deposit of 25% will be due and upon receipt, the review of the emails will commence. At the completion of the review, the balance will be due prior to release.

Attached a copy of the 14 point analysis document for your reference.

Your reply is expected prior to proceeding with this request.
