Pursuant to the New York Freedom of Information Law, I hereby request any records that refer to any of the following:

1) the building and/or property located at 486 Broadway, NY, NY, including any records which refer to the retail store or retail premises located at 486 Broadway, NY, NY; and
1) the building and/or property located at 484 Broadway, NY, NY, including any records which refer to the retail store or retail premises located at 484 Broadway, NY, NY.

This record request includes, but is not limited to, any records that relate to the any investigation by the Commission on Human Rights into the accessibility of:
- the Madewell store or other retail stores/premises located at 486 Broadway, NY, NY and;
- the J.Crew store or other retail stores/premises located at 484 Broadway, NY, NY.

Lastly, I ask that you kindly recall that under the Freedom of Information Law all records are presumed to be available pursuant to a request for records, unless a specific exemption applies. Moreover, to the extent an exemption applies, such exemption must be narrowly construed. Therefore, any records or parts thereof to which the exemption does not specifically apply, must be disclosed. As the New York State Committee on Open Government has explained "[s]tated differently, all records of an agency are available, except to the extent that records or portions thereof fall within one or more grounds for denial appearing in §87(2)(a) through (l) of the [Freedom of Information] Law".

In the event that there are fees due to fulfill my request, please inform me if the total charges will exceed $200 in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Mr. Hanski:
In my capacity as Records Access Officer (“RAO”) of the New York City Commission on Human Rights (“Commission”), I write concerning the above referenced FOIL request. For the reasons set forth below, your request is denied. FOIL Request By direct entry into the City’s OpenRecords system on June 26, 2019, you submitted a request for records pursuant to the Freedom of Information Law, Art. 6, New York Pub. Off. Law (“FOIL”). In that request, you sought 1) the building and/or property located at 486 Broadway, NY, NY, including any records which refer to the retail store or retail premises located at 486 Broadway, NY, NY; and 1) the building and/or property located at 484 Broadway, NY, NY, including any records which refer to the retail store or retail premises located at 484 Broadway, NY, NY. This record request includes, but is not limited to, any records that relate to the any investigation by the Commission on Human Rights into the accessibility of: - the Madewell store or other retail stores/premises located at 486 Broadway, NY, NY and; - the J.Crew store or other retail stores/premises located at 484 Broadway, NY, NY.” Responsive Records May Exist but are Exempt from Disclosure To the extent you are seeking records of matters currently under investigation, and without confirming or denying their existence, such records, if the Commission possessed them, would be exempt from disclosure under the New York Freedom of Information Law §§ 87(2)(e)(i) and (e)(ii). These provisions apply where records are compiled for law enforcement purposes and their disclosure would interfere with law enforcement investigations or deprive a person of a right to a fair trial or impartial adjudication. Accordingly, your request is denied to the extent you seek records of matters currently under investigation. No Responsive Records Exist To the extent you are seeking records concerning closed investigations involving the entities specified in your request, I can confirm after a reasonable and diligent search that no such records were found.
