Pursuant to the New York Freedom of Information Law, I hereby request the following records:
Any record in possession of the Office of Mayor as of May 1, that was received from any law enforcement agency at any time between the date of January 1, 2022 until April 30, 2023, that mentions or describes the existence of cannabis laced with fentanyl or which warns about cannabis laced with fentanyl.
A list of possible sources of this information (that is neither exhaustive nor exclusive) may include intelligence bulletins published by the New York City Police Department, the New York State Police, the NYC Special Narcotics Prosecutor's Office, the U.S. Drug Enforcement Administration, the Office of National Drug Control Policy, the Department of Homeland Security, and/or the New York/New Jersey HIDTA.
Attached, please find a PDF describing an event where the Mayor has publicly stated his knowledge that there is cannabis laced with fentanyl being sold to children.
As the Mayor has repeatedly alluded to the existence of cannabis laced with fentanyl at New York City bodegas, the Office of Mayor has waived any right to invoke law enforcement secrecy, or cite For Official Use Only/"FOUO" markings (that have no legal standing) or similar exceptions to FOIL.
There is no forseeable harm in disclosing a document claiming that cannabis is laced with fentanyl, and the examination of these records as well as the source of the claim that cannabis is laced with fentanyl is a matter of ongoing public concern. As such, there is no legal reason to withhold the requested records.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
