Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:

The proposed agreement of revocable consent between Amtrak and the New York City Department of Transportation which was published in the City Record on October 1, 2014, quoted below:

"#4 IN THE MATTER OF a proposed revocable consent authorizing
National Railroad Passenger Corporation (Amtrak) to construct,
maintain and use a tunnel under and across Eleventh Avenue, north of
West 30th Street, in the Borough of Manhattan. The proposed revocable
consent is for a term of 10 years from the date of Approval by the
Mayor to June 30, 2025 and provides among other terms and
conditions for compensation payable to the City according to the
following schedule:
From the date of Approval by the Mayor to June 30, 2015 - $44,584/annum
For the period July 1, 2015 to June 30, 2016 - $45,801
For the period July 1, 2016 to June 30, 2017 - $47,018
For the period July 1, 2017 to June 30, 2018 - $48,235
For the period July 1, 2018 to June 30, 2019 - $49,452
For the period July 1, 2019 to June 30, 2020 - $50,669
For the period July 1, 2020 to June 30, 2021 - $51,886
For the period July 1, 2021 to June 30, 2022 - $53,103
For the period July 1, 2022 to June 30, 2023 - $54,320
For the period July 1, 2023 to June 30, 2024 - $55,537
For the period July 1, 2024 to June 30, 2025 - $56,754
the maintenance of a security deposit in the sum of $100,000 and the
insurance shall be the amount of Two Million Dollars ($2,000,000) per
occurrence, and Five Million Dollars ($5,000,000) aggregate."

If by the time this request is processed, the proposed agreement has been finalized, please include the finalized agreement of revocable consent.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
