Pursuant to the New York Freedom of Information Law, I hereby request the following records:

- Copies of all forms currently used by the department to evaluate an officer/candidate's ability to speak, read, and write languages other than English.

- Copies of department policy on interacting with deaf and hard of hearing individuals

- Copies of department policy on interacting with people with limited English proficiency (LEP)

- Copies of department policy related to American Sign Language, if any

- Copies of forms currently used by the department, if any, to evaluate an officer/candidate's knowledge of American Sign Language

- If there exists documentation, such as spreadsheets, of which officers are currently certified as interpreters or speaking any second language (e.g. Spanish, Vietnamese,) please include this as well.

This is an appeal for request FOIL-2019-056-20857, which was rejected on 11/27/2019.

The NYPD rejected my request for documents related to officers' language proficiency training and language policies based on a lack of responsive documents. One of the items requested was "Copies of department policy on interacting with people with limited English proficiency (LEP)." Even a cursory Google search returns documents titled"NYPD Language Access Plan for Limited English Proficienct (LEP) Persons" for multiple periods of time, with one amended as recently as 2018. I have attached that document and a prevision revision from 2012 to this appeal letter.

NYPD also has multiple services and policies for deaf and hard of hearing individuals as reported in local news media, such as a sign-language app to"help officers speak with the deaf." The Americans with Disabilities Act (ADA) requires that "law enforcement agencies must provide the communication aids and services needed to communicate effectively with people who are deaf or hard of hearing, except when a particular aid or service would result in an undue burden or a fundamental change in the nature of the law enforcement services being provided." Therefore, it is not unreasonable to assume the NYPD has many policies related to how officers interact with deaf and hard of hearing individuals.

New York's FOIL law requires that agencies conduct a "diligent" search for records it may possess. For the reasons outlined above, showing clearly that records pursuant to my request exist, I appeal.
