Hello,
I am sending this appeal for my NYPD-rejected FOIL request, FOIL-2022-056-05231.
The request was for: "Documents outlining the line-itemed budget of New York City's Crime Gun Intelligence Center for the most recently completed fiscal year."
The rejection stated: "In regard to the document(s) which you requested, I must deny access to these records on the basis of Public Officers Law Section 87(2)(e)(iv) as such information, if disclosed, would reveal non-routine techniques and procedures."
Public Officers Law Section 87(2)(e)(iv) exempts "criminal investigative techniques or procedures, except routine techniques and procedures" from disclosure via FOIL. A budget is neither a "technique" nor a "procedure," and would most certainly not elucidate criminal investigative techniques or procedures. It is also as "routine" as public records can get, since it is the annual itemization of taxpayer funds that any government body needs to compile to be able to operate.
I would appreciate if you could review this determination and disclose the requested records.
