Pursuant to the New York Freedom of Information Law, I hereby request the following records:
A log of all FOIL requests since January 1, 2020, including but not limited to the text of such requests.
The up-to-date FOIL subject matter list for EDC.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

In my prior dealings with city and state agency FOIL requests, I have seen the agency proffer dates 60 days ahead as the expected completion date, only to further delay by 60 days on that date. More than one agency illegally repeated this at least a half dozen times.
Can I expect this FOIL request to actually be completed on or before December 18, 2023? If not, I will not hesitate to appeal on grounds of constructive denial.

Please confirm for me that the estimated completion date of December 18, 2023 is accurate and true.
Should this date later be revised, let the record reflect that I made efforts to work with the agency before reaching for the route of appeal on grounds of constructive denial.

It has been approximately 12 business days since my November 20 communication requesting confirmation that December 18, 2023 is the honest, sincere, intentional, and realistic completion date for this request.
Let the record reflect that I am attempting to work with the agency in good faith, and give them opportunities to comply with the letter and spirit of the law.
Absent further confirmation, I think it's reasonable to assume the agency shall produce responsive documents on or before December 18, 2023, to meet their own schedule. If documents are not produced by then, or if the estimated completion date is extended further, I will not hesitate to appeal on grounds of constructive denial.
