Ok, I am not that happy about that date, but if the DOB will actually produce documents on that date, I may accept it.

My prior experience with the city involves agencies repeatedly declaring that documents will be furnished by a specific date 60 days in the future, only to (on that date) again delay it by 60 days. Will the DOB commit to releasing records by Wednesday, February 14, 2024? I will not hesitate to appeal on basis of constructive denial should that date be missed.

For the above, the information for the request was posted in the portal on April 19, 2021:

The Department of Buildings ("DOB") is in receipt of your FOIL Request no. 2020-810-03664 regarding COVID-19 Testing Data ("FOIL Request") dated November 1, 2020. DOB now provides the following responses:

The "list" mentioned by one of your employees in widely viral incident in a yeshiva, in which the employee stated, on or about October 26, 2020, that she was given a list
Regarding religious institutions/schools. The video can be viewed at https://www.theyeshivaworld.com/news/featured/1913743/shock-video-out-of-controlnyc-
health-dept-inspectors-visit-empty-yeshiva-start-writing-summonses.html, and the admission of a list can be seen at 1:39.

Request denied. DOB has no material that is responsive to request no. 1. Please note the link that you have provided states that the persons shown in the video are "nyc-health-dept-inspectors."

All directives, guidances, correspondence, memoranda, and all other records regarding COVID-19-related enforcement in the Jewish communities in Kings County September 1, 2020 through October 30, 2020;

Request denied. DOB has no material that is responsive to request no. 2. Per New York State Public Officers Law sec.89 (3) (a), request no. 2 fails to "reasonably describe" a record that DOB maintains.

All data, notes, correspondence, memoranda, final documents and other related records relating to COVID-19 testing in the zip codes 11204, 11210, 11219, 11229, and 11230 that were/are being sent to the Mayor's Office, NYC Department of Health and Mental Hygiene or another city agency from September 1, 2020 through October 30, 2020;

Request denied. DOB has no material that is responsive to request no. 9.

All data, notes, memoranda, and final documents relating to CoVID-19 testing in the zip codes 11204, 11210, 11219, 11229, and 11230 that were/are being sent to the Governor's Office or from the Governor's office to NYS Department of Health or another state agency from September 1, 2020 through October 30, 2020.

Request denied. DOB is not included among the agencies listed in request no. 10 and has no material that is responsive to request no. 10.
