In my prior dealings with city and state agency FOIL requests, I have seen agencies proffer dates 60 days ahead as the expected completion date, only to further delay by 60 days on that date. More than one agency illegally repeated this more than half a dozen times.

Can I expect this FOIL request to actually be completed on or before Saturday, February 24, 2024? If not, I will not hesitate to appeal on grounds of constructive denial.

I never received a response to my 11/20/2023 communication.

Because of this, in concert with my prior experience with MTA FOIL, I no longer consider the agency to be cooperative or acting in good faith.

There is a nearly two year old responsive document available on the MTA website. I would like an up to date version. This is not a complex request. I neither consider 60 days a reasonable timeframe for a response, nor one that is likely to be met.

Furthermore, in the past, I have had appeals denied on basis of timeliness after MTA appeals review took more than a week to open the mail, and then improperly considered that later date of mail opening to be the appeal date.

So far, I have only once had the MTA execute a FOIL request in a reasonable time period.

Thus, as a portion of the grander fractal of kafkaesque bureaucracy, I cannot reasonably assume the MTA is proceeding with my FOIL request, and am appealing on the basis of constructive denial.

Hire more staff.
