From: T. McElwee

To Whom It May Concern:

In accordance with Executive Law § 94(19)(a) and Commission regulations for access to publicly-available records, I request the following records from the Commission:

For all Political Party Chairs as defined in Public Officers Law § 73(1)(k), a PDF copy of Financial Disclosure Statements as well as Notices of Deficiency that cover the period of 2019, (due within calendar year 2020). Per definition, the scope of this request includes Political Party Chairs at the level of the State as well as Political Party Chairs at the level of County where the County has population above 300,000 or where the Chair receives compensation in excess of $30,000 in a calendar year.

This request is being made at the revised deadline in anticipation of grant/denial at the earliest date; please advise of this date.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter.

Sincerely,

T. McElwee

Thank you, I have the date calendered.

Out of an excess of curiosity I would like to ask: is a Chair who served 2019 and resigned in early 2020 still required to disclose for the year 2019?

To whom it may concern:

This is a follow-up on a previous request for records (for the disclosures of Political Party Chairs, from August 18, 2020).

I would like to ask if there are Notices of Deficiency that have gone to Political Party Chairs covered under Public Officers Law § 73(1)(k), that cover disclosures for activities in 2019?

The last disclosure form I have received was in September 16, 2020, and was dated as of May 2020. Please let me know if there are further disclosure forms or Notices of Deficiency for Political Party Chairs.

Specifically, I wish to note that Frank Seddio was the Chairman of the Kings County Democratic Party for calendar year 2019, but I have not received either a Disclosure Form or Notice of Deficiency.

Please let me know if Mr. Seddio is now exempt, has filed a disclosure form or has been issued a notice of deficiency.

Thank you,
TM

As to your question about Frank Seddio, I cannot comment about a specific filer, but generally, if someone leaves their position before the deadline for submitting a financial disclosure filing for the prior calendar year, they would not be required to file. As to your question about notices of delinquency, any notices of delinquency that have been issued so far this year can be seen on our website at https://jcope.ny.gov/view-delinquent-filings-financial-disclosure-statements.
