Pursuant to the New York Freedom of Information Law, I hereby request the following records:

Any and all compliance assessments pertaining to Rensselaer County Correctional Facility completed since November 3, 2016.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

As previously acknowledged, the Commission is in receipt of your Freedom of Information Law request, dated April 1, 2019, requesting a copy of all compliance assessments pertaining to Rensselaer County Jail that were completed since November 3, 2016.

Attached, please find the documents responsive to your request. Please be advised that certain portions of the attached records have been redacted pursuant to Public Officers Law §87(2)(f). These portions contain specific details relative to correctional facility operation, and security. As such, the Commission is of the position that public disclosure of these details may endanger the life or safety of staff and inmates. Such a record is not therefore subject to FOIL pursuant to Public Officers Law §87(2)(f), and that portion of your request is hereby denied.

The attached records have also been redacted pursuant to New York Public Officers Law §87(2)(a), to remove information exempt from disclosure under state statute in accordance with New York State Civil Rights Law §50-a.

Pursuant to Public Officers Law §89(4)(a), you may appeal this determination to Brian M. Callahan, General Counsel, New York State Commission of Correction, Alfred E. Smith State Office Building, 80 S. Swan Street, 12th Floor, Albany, New York 12210.
