Hello,
I am appealing this denial of my FOIL request. It is not my understanding that emails of government officials — which I have regularly obtained through FOIL requests, including from members of the executive chamber — are exempt from disclosure by state or federal statute, as the above rejection claims. I fail to see how a specific subset of emails of two employees of the executive branch during a three week period could be exempt from disclosure for this reason.
Furthermore, Public Officers Law (87)(2) states that "A denial of access shall not be based solely on the category or type of such record and shall be valid only when there is a particularized and specific justification for such denial." Such justification was not given in the denial of my request.
I request that my appeal be granted and the records provided to me. If my appeal is denied, please provide a "particularized and specific justification" for that denial, as is required by statute.
