Pursuant to the New York Freedom of Information Law, I hereby request the following records:

All materials and correspondence between the district Board of Education, district Administration, district Equity Committee or Office, Faculty, Staff, Third Party Contractors and Consultants related to the following terms, subjects or concepts between April 2021 to the date this request is fulfilled:

This request shall also include any teachings of such curriculum mentioned above by any faculty employed within the school district, third party contractors, consultants or other third parties invited by the school or agents of the school.

This request shall also include any documents or materials accessed by the school district, but stored on third party service providers on behalf of the district, and links/references/credentials for access to such materials if present in emails or electronic systems or files stored in browser caches, cloud storage (i.e. Google Drive, Dropbox, OneDrive, etc), or local hard drives managed by the district. This request shall also include non-school email and texting services used by the district, board, administration and faculty to conduct activities and business related to the school district (i.e. Gmail, Outlook, etc).

This request shall also include any training material or supplemental information provided to district staff, whether required or suggested.

Please keep in mind, pursuant to the Retention and Disposition Schedule for New York Local Government Records (LGS-01): Any record listed in the LGS-01 Schedule for which a Freedom of Information (FOIL) request has been received should not be destroyed until that request has been answered and until any potential appeal is made and resolved, even if the retention period of the record has passed.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Mr. Parker:

This letter is sent in furtherance of your Freedom of Information Law
(“FOIL”) request to the Locust Valley Central School District dated March
6, 2023. Specifically, you requested a litany of emails between the
District, the Board of Education, the Equity Committee, Faculty, Staff,
Third Party Contractors and Consultants with 18 search terms over a period
of two years.

The general disclosure statute applicable to state and local government
entities in New York is the New York State Freedom of Information Law
(“FOIL”). As a general matter, the FOIL is based upon a presumption of
access. Stated differently, all records of an agency are available, except
to the extent that records or portions thereof fall within one or more
grounds for denial appearing in §87(2)(a) through (i) of the Law.

It is important to note that FOIL provides access to existing District
records. Furthermore, the Committee on Open Government has opined that a
school district is not required to create documents made in response to a
FOIL request, but rather to produce documents. Similarly, nothing in FOIL
requires an agency to supply information in response to questions.

Based on the extreme broad nature of your search, the School District
cannot quantify the amount of emails that may be responsive to your
request. Once it is determined what may or may not be responsive, each
e-mail correspondence must be reviewed to determine which, if any, contain
potential education records, which would preclude such records from FOIL
disclosure under Public Officers Law 87(2)(a) and the Federal Education
Rights and Privacy Act (20 U.S.C. 1232g), an invasion of personal privacy
in accordance with Public Officers Law 87(2)b) or interagency documents
under Public Officers Law 87(2)(g). In addition, certain emails may be
precluded from disclosure under other relevant sections of the Public
Officers Law §87(2)(a), (C.P.L.R. §3101(c), and C.P.L.R. §4503(a)).

For these reasons, your request is overly broad and cumbersome on the
resources of the School District. The Committee on Open Government has
held that it is unreasonable to require an agency to review thousands of
records that may contain a particular search term or terms in response to a
Freedom of Information Law request.

As such, please provide the School District with further clarification
regarding your FOIL request in order for the School District to be able to
begin to review documents that may be responsive to your FOIL request. If
you are able to provide additional details as to the records you seek, the
School District may be able to locate responsive documents to your FOIL
request and undertake a review to further determine which records, if any,
are subject to disclosure under the FOIL.

Thank you for your response to my Freedom of Information Law request dated March 6, 2023. I understand the concerns regarding the breadth of my original request and would like to provide clarification to help narrow the scope and make it more manageable for the Locust Valley Central School District to process.

Please consider the following modifications to my original request:

Timeframe: Limit the search to records and correspondence from January 1, 2022, to the date this revised request is processed.

Search Terms: Instead of the 18 original search terms, please focus on the following eight terms:
a. Equity
b. Culturally Responsive
c. Implicit Bias
d. People of Color
e. Social Justice
f. Diversity
g. Decolonize
h. Intersectionality

Correspondence: Focus the search on correspondence between the district Board of Education, district Administration, and district Equity Committee or Office only. Exclude correspondence between faculty, staff, third party contractors, and consultants unless they are directly communicating with the aforementioned groups.

I hope these clarifications and modifications will make the request more manageable for your team. I appreciate your assistance in locating and providing any responsive records to this revised request.

Information Law (“FOIL”) request received by this Office on April 14th.

Due to the nature of the materials sought, the District will respond to
your request by either granting or denying the request in whole or in part
within approximately twenty (20) business days from the date of this
acknowledgment letter. However, if circumstances prevent the disclosure of
the materials sought within twenty (20) business days from the date of this
acknowledgment letter, the District will contact you in writing to provide
a reason for the inability to grant the request within such time period and

Dear Ms. Horoszewski,

Thank you for acknowledging my amended Freedom of Information Law (FOIL) request on April 14, 2023, and for providing an approximate timeline of twenty (20) business days for a response.

Given the potentially large volume of records that may be responsive to my amended request, I would like to kindly request that the Locust Valley Central School District consider providing a rolling response to my request. A rolling response would involve releasing records as they become available, rather than waiting to provide all the records in one complete response. This would allow for more efficient processing of my request and enable me to start reviewing records sooner.

Please let me know if a rolling response is feasible for your office, and if so, the expected schedule for releasing records.
