Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:
Data on locations (stations) of fare evasion arrests in the New York City Subway system and demographics (age, race, gender only) of arrestees for the year 2012.
I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Dear Ms. Burrington,
This is in response to your Freedom of Information Law request, in which
you requested data regarding the locations of fare evasion arrests made
in the New York City subway system and a demographic breakdown, by age,
race and gender, of the arrestees, for the year 2012.
First, I would like to apologize for the delay in responding to your
request. The NYCT Law Department receives hundreds of Freedom of
Information Law requests each year and we are currently experiencing a
backlog of requests which we are seeking to address. In addition, your
request was mailed to the address of the MTA Law Department, at 347
Madison Ave, New York, NY 10017, not to the MTA - New York City Transit
Law Department, at 130 Livingston St, Brooklyn, NY 11201. This resulted
in a delay in my office receiving your FOIL request.
Regarding your request for statistics on fare evasion arrests, those
records are not maintained by MTA - New York City Transit. They are
maintained by the New York City Transit Police, which is a division of
the New York Police Department. In order to obtain these statistics you
need to make a FOIL request to the NYPD. You should address any FOIL
request to the NYPD to:
