As you are aware, the requested records are email communications between Jennifer Bennett and employees, contractors, consultants, advisors, board members, administrators or staff of the Shenendehowa Central School District. Given the nature of the communications and the public interest in transparency and accountability, I believe that the requested records are of significant public interest.

Therefore, I respectfully request that the District waive any fees associated with the retrieval and disclosure of the requested records. If the District is unable to waive the fees, I would be willing to work with you to narrow the scope of the request to minimize the associated costs.

Thank you for your response to my recent Freedom of Information Law (FOIL) request for communications involving Jennifer Bennett. I understand that the cost to retrieve and disclose these records is estimated to be $901.50.

However, I would like to appeal the decision to deny my request for a fee waiver based on the public interest in the disclosure of these records. As you may be aware, Ms. Bennett was involved in the surveillance of board candidates, and the public has a right to know how the school board is using public funds and resources. The disclosure of these records will provide transparency and accountability to the Shenendehowa Central School District and will enable the public to have a better understanding of how the district conducts its business.

Furthermore, I would like to point out that the New York State Committee on Open Government has stated that the public interest is a factor to be considered in determining whether a fee waiver is appropriate.

Therefore, I respectfully request that you reconsider my request for a fee waiver and provide the requested records without charge. I would be willing to accept the records in an electronic format, if possible, to reduce the cost of reproduction.

It is with great disappointment that I must express my concerns regarding the handling of my Freedom of Information Law (FOIL) request. As a citizen committed to truth and justice, it is my belief that transparency and accountability are essential components of any functional democracy. As such, I had requested any and all emails, paper communications, receipts, invoices, memorandum, meeting notes referencing or from/to Jennifer Bennett or other emails/phone numbers used by Jennifer Bennett between any and all employees, contractors, consultants, advisors, board members, administrators, or staff of the Shenendehowa Central School District from 1/1/2019 to the date this request is completed. Your search was completed, and you found responsive records.

Despite my efforts, I received an estimate of at least $901.50 in fees to retrieve and disclose the requested records. While I did request a waiver of these fees based on the significant public interest in the requested records, my request was denied. As a result, I appealed the decision and requested that the fee be waived once again, citing the New York State Committee on Open Government's stance on the importance of considering public interest in such matters.

Despite my efforts, the District responded by indicating that they will not respond to further correspondence on the matter. This lack of response is particularly concerning to me, as it suggests that the District may be trying to suppress material information from the public.

As a citizen committed to truth and justice, I implore the Shenendehowa Central School District to reconsider their position on this matter. The public has a right to know how the district conducts its business, particularly in regards to the use of public funds and resources. The requested records will provide transparency and accountability to the district, and will enable the public to better understand the district's operations. Therefore, I respectfully request that the District provide the requested records without charge, in an electronic format if possible, to reduce the cost of reproduction.
