Pursuant to the New York Freedom of Information Law, I hereby request the following records:

Background: In 2016, New York Attorney General Eric Schneiderman released a report which included findings of an investigation into consumer abuses in the live entertainment industry. The report can be found here: https://ag.ny.gov/pdfs/Ticket_Sales_Report.pdf

1. Please provide any communications, including emails and memos, between the Attorney General’s Office and representatives from Ticketmaster during the investigation and leading up to the release of the 2016 report above.
2. Please provide any data, supplemental to the 2016 report, that the New York Attorney General’s Office received from Ticketmaster leading up to the date the report was published.

Electronic records should be produced in their unlocked native format with all original metadata and original filenames. Paper documents should be scanned and produced as Adobe PDF files. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

The above request is a matter of public interest. The requested documents will be used in the course of reporting for VICE News. As such, we request a fee waiver. In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request.

If this request is denied in whole or in part, I ask that you justify all deletions by reference to specific exemptions of the New York Freedom of Information Law. Please inform us of the reason(s) for such denial in writing, and provide the name, mailing address, and email address of the person or body to whom an appeal should be directed. I expect the release of all segregable portions of otherwise exempt material. Please do not redact any non-responsive information from any records; we request the complete copies of any records with any responsive information.

In the interest of time, I request that you provide documents as they become available rather than waiting for the complete set.

Please be advised that records or portions of records that respond to your above-referenced FOIL request may be exempt from disclosure pursuant to Public Officers Law § 87(2)(d).  Public Officers Law § 87(2)(d) provides that an agency may deny access to records or portions thereof “that are trade secrets or are submitted to an agency by a commercial enterprise or derived from information obtained from commercial enterprise and which if disclosed would cause substantial injury to the competitive position of the subject enterprise.”
The entity that provided these documents has the right to submit a written statement of the necessity for granting or continuing such exception from disclosure.  Public Officers Law § 89(5)(b)(2).
These particular documents will be exempt from disclosure and kept apart from all other records until fifteen days after the entitlement to such an exception has been finally determined.  Public Officers Law § 89(5)(a)(3).  We will notify you when such exception has been finally determined.
