Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:
The applications submitted to the Defense Logistics Agency, Disposition Services by SUNY's Morrisville's campus police for enrollment in the 1033 program.
That SUNY Morrisville's campus PD is enrolled in the program has been published online here: http://www.capitalnewyork.com/article/albany/2014/10/8554535/report-suny-branches-armed-through-pentagon-program
Records requested include the application for M14 rifles, the utility truck, and any equipment that SUNY Morrisville's campus PD applied for but was denied.
I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

In response to your FOIL request – SUNY Morrisville has limited equipment through the surplus program. For your understanding, University Police are fully accredited law enforcement officers, the same as New York State Troopers or any city or county police agency.
SUNY Morrisville has three obsolete M-14 rifles that are used for the department’s honor guard. They also have one humvee that is for emergencies, typically natural disasters. It was most recently used to rescue people in a flood. When it was acquired by the school it didn’t work and the students in the automotive program fixed it up as part of their training.
The M-14s are valued at $138 each.
The humvees range from $35,000 to $39,441
I can arrange for you to speak with SUNY’s Commissioner of University Police if you need anything further.
This satisfies your FOIL and I am considering it closed.

Dear Ms. Whitney,
Thank you for responding to this request.
However, I did not request information or comment on the equipment obtained by SUNY Morrisville through the program. I requested the applications submitted by SUNY Morrisville to the DLA, DS.
Your response does not satisfy my FOIL request. You did not advise me of whether SUNY Morrisville possesses applications responsive to the request or not, and whether such applications are releasable.
I will be appealing this decision.
