Dear Police Chief Mark Samelstad,

Under the Wisconsin Open Records Law, ยง19.31 et seq., I am requesting a copy of the following public records:

1. A copy of the complete police file related to the investigation of Thomas Woznicki, a former teacher at New Richmond High School, for alleged sexual misconduct in 1994. Thomas Woznicki was charged with having sex with a child age 16 or older in violation of Wisconsin Statute 948.09. The charges (six counts) were filed against Thomas Woznicki in April 1994 and dismissed in July 1994. The case number associated with the criminal charges is St. Croix County Case Number 1994CM000204. Please provide a copy of the complete police file related to the above-referenced investigation. With regard to the delivery of the requested records, my preference would be to receive a scanned copy of the police file via email.

If there are any fees for searching or copying these records, please inform me if the cost will exceed $250.00 (two hundred fifty and 00/100 U.S. dollars).

I would request a response in writing, within the 5 days described by law, if you intend to deny this request. Also, if you expect a significant delay in fulfilling this request, please contact me with information about when I might expect a copy of the requested records.

If you deny any or all of this request, please cite each specific exemption you feel justifies the refusal to release the information and notify me of the appeal procedures available to me under the law.

Ms. Smith: I have researched Department Records and cannot locate any records relating to the investigation that this Department conducted on Thomas Woznicki in 1994. That investigation took place over 22 years ago. I have been the Police Chief for the City of New Richmond for almost 15 years. I have never seen the case file on Woznicki. The Department is required to keep records for seven years by Wisconsin State Statute. I am guessing that all records relating to Woznicki have been purged.
