Pursuant to the New Jersey Open Public Records Act, I hereby request the following records:

Public reports show that Deepfake nude images is a major topic of concern in American public schools: https://www.cbsnews.com/news/deepfake-nude-images-teen-girls-action-parents-lawmakers-ai-pandemic/

Therefore, I hereby request the following records:
1) All instructional materials, presentations and presentation materials related to deepfakes. This includes A) any notes taken during meetings that discussed deepfakes and B) Any other documents related to deepfakes including internal documentation, public relations materials, and executive summaries.
2) Any memos or communications sent to schools, administrators, teachers, parents, or students that mention “deepfake” or “deepfakes” or “AI-generated”
3) Any case studies, enforcement actions, or incident reports about deepfakes or AI-generated nude images
4) Any academic dishonesty policies that mention deepfakes
5) To the extent possible, any emails and associated attachments that mention deepfakes

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

The Department of Education does not make or maintain records responsive to parts 1, 3 and 4 of the above referenced request. Accordingly, those parts of your request are denied.

Regarding parts 2 and 5 of your request, a preliminary search using the parameters you identified in your request yielded over 1300 emails. In order to fulfill your request, the OPRA custodian would be required to review each of these emails to determine if they were responsive, then conduct a review for any privileged material that needed to be redacted or withheld, and finally conduct a review for any other redactions appropriate under the law, such as redactions of personally identifiable information.

Such a review would be unduly burdensome and substantially disruptive to the DOE's operations. Accordingly, we request that you modify the scope of parts 2 and 5 of your request. Otherwise, your request will be denied pursuant to N.J.S.A. 47:1A-5(g), which provides, in pertinent part, "If a request for access to a government record would substantially disrupt agency operations, the custodian may deny access to the record after attempting to reach a reasonable solution with the requestor that accommodates the interests of the requestor and the agency."
