Dear Mr. Harris,

The Town's IT personnel has retrieved communication per your 91:A request - "with Tesla Inc, or its representatives, regarding the purchase or operation of Tesla vehicle(s) for official or departmental use. Where appropriate, to include testing, trouble-shooting, data use and retention, AutoPilot use, servicing, and returns." I do want to let you know there has not been communication that includes testing, trouble-shooting, AutoPilot use (other than a document that speaks about Tesla's transition to Tesla Vision), returns.

Per your request you asked "if you would inform me of the total charges in advance of fulfilling my request." The Wolfeboro Police Department charges $5 for the first page and $1 for consecutive pages. The communication pages total 107 pages, bringing the total due to $111. The documents can be emailed (and are ready to be released to you via pdf attachments).

Thanks Sherri,

I appreciate your quick response on this, and the detailed estimate.

I have a limited budget for FOIA. I'm particularly interested in communications about data use and retention, if that might help narrow down the request? (Servicing is a much lower priority).

I do not have any of that data information. The communications (emails) that I have available are all on the purchase of the tesla and one email for the purchase for the charging station.

Mr. Harris,

I am just curious as to the purpose of your inquiry. Do you live in Wolfeboro? In NH? Is Muckrock anti-Tesla or anti-electric vehicle? This was a donation…a free vehicle accepted by the Town. We do not track any data on the Tesla other than electricity and repair costs. We cannot create nor are we compelled to create documents that don’t exist.

Causing any agency to spend time and money on voluminous inquiries for information under the FOIA is a waste of that time and resources for that agency when the information requested is not specific and/or not reviewed by the requesting party.

I’d also be interested in what the “need” is for the information you thought you were in need of until you saw the cost, or a potential future “need”.

Sincerely,

Stephen D. Wood
Police Commissioner

Hi Stephen,

I'm an investigative journalist based in Seattle, WA, working on a series of stories about Tesla, and in particular whether any police departments using Teslas as official vehicles have any conecerns about the data the vehicles collect and share with Tesla.

It sounded from Ms Moore's helpful and timely reply that you have no such concerns or, at least, have not put them into emails to Tesla. As such, there was no immediate need for me to obtain the documents. At no point did I request documents to be created.

If you'd be willing, I'd appreciate a few minutes of time for a phone interview on the topic. markellisharris@gmail.com 206 734 5599

Muck Rock is a platform that simplifies the procedure for filing public records requests nationwide. It has no editorial role in my story, which would likely end up in a publication such as TechCrunch or Wired.

If you have concerns about New Hampshire's FOIA laws, you would do best to address those to your legislators.
