Pursuant to the California Public Records Act, I hereby request the following records:

1. The total number of sheriff's deputy use of force incidents, broken down by type of force used, between 2013-2018 (separated by year).
2. The total number of people that deputies used force against, between 2013-2018 (separated by year).
3. The total number of use of force complaints reported between 2013-2018 (separated by year).
4. The total number of use of force complaints sustained between 2013-2018 (separated by year).
5. The policy manual of the sheriff's department.
6. The current union contract between the city and any sheriff's deputy/police officer unions.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

A document has been released for record request #19-96 along with the following message:

Napa County received your Public Records Act request seeking statistics relating to use of force by deputy sheriffs. Below, please find the County’s responses to your individual requests.

1) The total number of sheriff's deputy use of force incidents, broken down by type of force used, between 2013-2018 (separated by year).

With the exception of use of force incidents involving K-9s, Napa County does not keep or maintain a database of statistics breaking down use of force by type and year. The total number of use of force incidents for the time period specified was 257. The numbers of use of force incidents involving K-9s are as follows:

2014 - 12

2015 - 12

2016 - 7

2017 - 17

2018 - 4

The County no longer possesses or maintains the data requested for uses of force involving K-9s for the year 2013.

2) The total number of people that deputies used force against, between 2013-2018 (separated by year).

Napa County does not possess or maintain this data separately from the data provided above for request #1. Thus, other than the data provided above for request #1, Napa County does not possess or maintain the records sought by your request #2.

3) The total number of use of force complaints reported between 2013-2018 (separated by year).

Napa County does not keep or maintain a database of statistics breaking down complaints relating to use of force incidents by year. The total number of complaints relating to use of force incidents for the time period specified was 4.

4) The total number of use of force complaints sustained between 2013-2018 (separated by year).

None of the complaints received during the time specified was sustained.

5) The policy manual of the sheriff's department.

Enclosed, please find a link allowing you to view and download the Napa County Sheriff’s Policy Manual. Please note that certain law enforcement policies have been withheld under Govt. Code sec. 6255 out of a concern for officer and public safety. The public interest in withholding these records clearly outweighs the public interest in disclosure, in light of the public’s interest in ensuring that peace officers remain safe during the execution of police procedures that could endanger life. Disclosing these policies would jeopardize officer safety and the safety of members of the public by unveiling protocols intended to ensure the safety of officers during situations of increased risk of violence, allowing individuals to counteract these safety procedures and endanger lives. The specific policies withheld pursuant to this exemption are:

Policy 404 – SWAT and Crisis Negotiation Teams

Policy 407 – Hostage and Barricade Incidents

Policy 408 – Response to Bomb Calls

6) The current union contract between the city and any sheriff's deputy/police officer unions.
