Pursuant to the Washington Public Records Act [RCW 42.56] I hereby request the following records:

I request a complete electronic copy of all Public Records Requests received by Snohomish School District and a complete electronic copy of the District's Responses to these Public Records Requests for the time period January 1, 2010 through November 4, 2021.

In the event the District chooses to provide these records in installments over time I request the records to be produced in reverse chronological order - from the most recent records to the earliest.

If this request is denied in whole or part, I ask that you justify all deletions by reference to specific exemptions of the PRA. I also request a detailed contemporaneous log to be provided for any document withheld or redacted.

For each responsive record the District contends is exempt from public disclosure, in whole or in part, please specifically identify the record by subject, title, author, custodian and date, and state how a specific statutory exemption applies to each record as required by RCW 42.56.210(3) and Rental Housing Ass'n v. Des Moines, 165 Wn.2d 525, 199 P.3d 393 (2009).

I request electronic production of all electronic records in the original NATIVE electronic format for each record.

I request for these public records to be produced by public (no password) e-mail attachment or link. If electronic attachment or link is not possible, an alternative would be to produce responsive records via USB DRIVE or DATA CD-ROM.

THIS REQUEST IS NOT BEING MADE FOR COMMERCIAL PURPOSES.

The requested documents will be made available to the general public.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request.

Dear “PRA Audit” Requester,
Pursuant to RCW 42.56.520, this letter is to acknowledge receipt of the public records request you submitted to the Snohomish School District (“District”) on November 4, 2021 via email. The district received the request on November 5, 2021. Specifically, in that email you requested the following records:
· I request a complete electronic copy of all Public Records Requests received by Snohomish School District and a complete electronic copy of the District's Responses to these Public Records Requests for the time period January 1, 2010 through November 4, 2021.
The retention period for districts to retain records request is two years after the request fulfilled in accordance with Public Disclosure/Records Request (DAN GS 05001 / GS2010-014). As a result, the Snohomish School District does have some records requests dating back past that retention period that we will include, however, we do not have all requests and responses dating back to January 1, 2010.
You also requested that these records be provided to you in native electronic format. The District interprets that to mean that you would like the native format of the records as they were provided to each requester. Please let us know as soon as possible if this is not a correct interpretation of your request for records in native format. Please also be aware that a good portion of the records produced may not be possible to provide records in native format due to redactions made in those records or redactions that must be made to the records before they are provided to you.
Because of the broad nature of your request, please understand that it will take the District a significant amount of time to fill the request. If you would like to narrow the scope of your request so that we may provide you with the records you are seeking in a more expeditious manner, you are always welcome to do so.
Please understand that although these records were previously provided to requesters in response to public records requests, they will all have to be reviewed for student information that is protected by the Family Educational Rights and Privacy Act and other applicable exemptions related to both students and employees, as many of the records requests responsive to your request were made by families of students or District employees themselves.
The cost for this many records requested can be significant. Per District Procedure 4040P before beginning to make copies, the Public Records Officer or designee may require a deposit of up to ten percent of the estimated cost of copying/producing all the records selected by the requestor. We will contact you with an initial estimate of applicable costs and the deposit required so that you may send payment. Please send payments to: Snohomish School District, Attn: Accounting Department, 1601 Avenue D, Snohomish, WA 98290.
The District can provide installments of records starting in reverse chronological order with an estimated date of January 14, 2022 for an initial installment of records if we receive the deposit in a timely manner. For each installment we provide we will notify you of the cost of the records and will need to receive payment before sending the documents.
The District currently estimates it will be able to provide you with all records responsive to this request by August 31, 2022. Please also understand that the estimated date of completion is an estimate and may be subject to change depending on a variety of factors, including when we receive the initial deposit from you, and the volume and complexity of records that are responsive to this request. If we require additional time to provide you with records responsive to your request, we will be sure to notify you in writing. This estimated date will allow time for the District to conduct a search for all responsive records, review the records for information that is exempt for disclosure under the Public Records Act, apply any necessary redactions, and produce an exemption log to explain any redactions made to the records.

Dear Ms Radek,

Thank you for your letter including the initial estimated cost of producing responsive records.
I have some questions regarding your fee estimate of $2,791.

Please correct me if I am wrong but referencing the .xls document you provided, it appears that in the year 2020-2021 the District possesses 1567 pages of responsive public records that need to be scanned @ .10 per page. Is this correct? (Referencing .xls document line numbers # 2-31)

These 1567 pages of documents for (presumably) years 2020-2021 are currently only available in paper form and need to be scanned?

These documents do no exist in electronic email or in .pdf form?

Also, can you please provide a more detailed description of each line entry of the “FILE” column of the excel document referencing the public records requests received by the District?

This would be very helpful.

On January 12, 2022 we received a follow up email asking if 1567 documents for 2020-2021 are currently only available in paper form and need to be rescanned. District Response: After additional analysis of the format of the records available to the district to respond to your request, we have revised the initial estimated cost of providing you with responsive records. The district now estimates this cost to be $133.75. This estimate is based on the updated figures contained in the revised Excel spreadsheet, which is included with this communication.
You also asked for a more detailed description of each line entry of the “FILE” column of the excel document referencing the public records requests received by the District? District Response: The File column is a listing of each of the records request the district has received in each year. It is a unique identifier that allows the district to keep track of each record we are going to provide for you.
Per District Procedure 4040P before beginning to make copies, the Public Records Officer or designee may require a deposit of up to ten percent of the estimated cost of copying/producing all the records selected by the requestor. The newly revised initial estimated cost of the records is $133.75, this is just an estimate as costs will be ongoing as records are proceeded. In order to get started producing documents the district will need a deposit of $13.75 (10% deposit). Please send payment to: Snohomish School District, Attn: Accounting Department, 1601 Avenue D, Snohomish, WA 98290. Once the district has received your deposit, we will begin producing records with an initial installment date of March 11, 2022.
Please let us know the best way to get you the records, if you have an FTP site the district can use to upload the records or if you want us to put them on thumb drives to deliver them to you. Please note, if you would like them on thumb drives then you would be responsible for paying the cost of the thumb drives and postage.
If the district does not receive a deposit from you within 30 calendar days, the district will consider this public records request abandoned and discontinue work on the request.

To answer your question, I am looking into the possibility of providing FTP site access for you to send files to. Can you please provide me with a cost estimate should we use USB thumb drives and USPS postage? The cost per unit, postage cost, and number of units needed? Thank you.

It is hard to give an estimate. We use 2gb thumb drives that are approximately $5 each. We have a lot of records though so I am thinking we will need to use 10 or so?? I can also see if I can buy larger thumb drives that will hold more but they also costs more. We only charge for the exact postage and costs of the thumb drives.
