Lists of Records Requests and Complaints - Immediate Disclosure Request (SF City Attorney)

Good afternoon,

** Note that all of your responses (including disclosed records) may be automatically and instantly available to the public on the MuckRock.com service used to issue this request (though I am not a MuckRock representative). In preparation for publishing my story on the audit of San Francisco public records compliance, I will also be sampling your responses to other persons.

This is a new Immediate Disclosure Request under the San Francisco Sunshine Ordinance and the CPRA, made on October 5, 2019. This is also a 67.21(c) request for the statement of quantity, nature, and form (even if exempt!) for each of the items below within 7 days without extension.

All records must be provided in rolling fashion. To make this go faster, the following information may be redacted WITHOUT providing particular justification: non-government personal email addresses, non-government phone numbers, non-government personal home addresses, non-government tax/bank/SSN/license/ID numbers; specifically you may state that all redactions not otherwise justified by specific instance happen to be one of those 4 categories and if true I will not contest that. All other redactions must be justified with particularity. Please also note that if you already released a record to someone else and waived any exemptions by doing this, you must also provide the record to me and without further redaction -- you cannot discriminate by requester. Do not exclude records merely because you think they are from or to me - remember I am merely one of many MuckRock.com users.

Please provide:

1. IMMEDIATE DISCLOSURE: an electronic copy of all logs, tables, lists, databases, or spreadsheet(s) used by your office to track public records requests between and including Jan 1, 2018 to Oct 5, 2019, including but not limited to subject, date received, date responded, staff member responsible, requester, status, etc. If your log has more than the dates specified do not truncate it - I am asking for the full logs that at least include those dates. You may provide native formats. Alternatively, you may export any spreadsheets to .CSV format - as your security or IT staff will tell you, CSV does not contain information that cannot be seen by non-technical examination. If CSV is infeasible, you are also welcome to virtually print such items directly to PDF form and redact them in Adobe. Do not cutoff information like long text that does not fit on the screen - that would be unjustified withholding. In order to ensure immediacy of disclosure, in this and only this request, native spreadsheet formats and metadata are NOT specifically required (though you are welcome to provide them if it can be provided immediately). However, do NOT physically print and scan the record - that just makes my life harder for no reason and will be appealed, and it is quite obvious the Task Force will likely again reject that.

If you do not have such logs covering Jan 1, 2018 to Oct 5, 2019, then instead provide #2 and 3. If you provide #1, you do not need to provide #2 or #3 at this time.

2. REGULAR DISCLOSURE: an electronic copy of all CPRA/Sunshine requests made to your office between and including Jan 1, 2018 to Oct 5, 2019. You are welcome to virtually print such items directly to PDF form and redact them in Adobe. Do not cutoff information like long text that does not fit on the screen - that would be unjustified withholding. In order to ensure rapid disclosure, in this and only this request, native email formats and headers are NOT specifically requested (though you are welcome to provide them if it can be provided immediately). However, do NOT physically print and scan electronic records - that just makes my life harder for no reason and will be appealed, and it is quite obvious the Task Force will again reject that.

3. REGULAR DISCLOSURE: an electronic copy of all CPRA/Sunshine request responses made by your office between and including Jan 1, 2018 to Oct 5, 2019. You do not need to provide the responsive *records* - just your responses (your determinations and transmittal letters). You are welcome to virtually print such items directly to PDF form and redact them in Adobe. Do not cutoff information like long text that does not fit on the screen - that would be unjustified withholding. In order to ensure rapid disclosure, in this and only this request, native email formats and headers are NOT specifically requested (though you are welcome to provide them if it can be provided immediately). However, do NOT physically print and scan electronic records - that just makes my life harder for no reason and will be appealed, and it is quite obvious the Task Force will likely again reject that.

In order to ensure rapid disclosure, in this and only this request, native email formats and metadata are NOT specifically requested (though you are welcome to provide them if it can be provided immediately). 5. REGULAR DISCLOSURE: an electronic copy of all CPRA/Sunshine responses to complaints made by your office between and including Jan 1, 2018 to Oct 5, 2019 - include any responses sent directly to requesters and also those to the SOTF. You are welcome to virtually print such items directly to PDF form and redact them in Adobe. Do not cutoff information like long text that does not fit on the screen - that would be unjustified withholding. In order to ensure rapid disclosure, in this and only this request, native email formats and metadata are NOT specifically requested (though you are welcome to provide them if it can be provided immediately). Please provide only those copies of records available without any fees. If you determine certain records would require fees, please instead provide the required notice of which of those records are available and non-exempt for inspection in-person if we so choose.

No. SFAC 67.25(b) provides for 10 days. I will wait only until CoB 10/18/2019.
The CPRA (6253(c)) applies only when its rules are less demanding than the Sunshine Ordinance.

SFAC 67.25 says "10 days" not "10 business days"

Ambiguities must be resolved in favor of providing the public greater access. Therefore since 6456.1 no longer exists you should follow the words of 67.25 and use '10 days.'

As always, your Good Government Guide has no legal authority to restrict right of public access - it is after all just a guide.

Below is an Immediate disclosure request. Exact copies are requested. Any format is fine other than printing/scanning.

Do not remove columns that you think are exempt. Keep the column names and redact the values if need be. If you withhold any info, you need to justify it with a footnote or other clear reference. You do not need to extract just year 2019 if your spreadsheet has more than 2019.
