From: JPat Brown

To Whom It May Concern:

Pursuant to the Freedom of Information Act, I hereby request the following records:

FBI Files on Father Albert Sidney Foley, the Jesuit priest, professor at Spring Hill College in Mobile, Alabama and anti-KKK activist (https://uscatholic.org/articles/201311/father-albert-foley-how-one-priest-took-on-the-kkk/). A previous request to the FBI indicated potentially responsive records were moved to NARA, and indicated I should use "44-HQ-16371" as a reference number.

I am making this request in my capacity as a journalist who has written extensively about government transparency, including several books on the FBI specifically. As such, I am not requesting a fee waiver, but I am requesting I be placed in the media requester category.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

JPat Brown

From: National Archives and Records Administration

Dear JPat Brown:

Thank you for submitting your Freedom of Information Act (FOIA) request to
the National Archives and Records Administration (NARA) via email to
FOIA@nara.gov. Your request concerns FBI file 44-HQ-16371.

Our office handles FOIA and Privacy Act requests for the NARA's
operational records
(records created by this agency). Since your request is for archival
records (records created by or originated in a different agency, but that
may have been transferred to the legal custody of NARA) to which access may
be restricted, we are forwarding it by this email to our Office of Research
Services, Special Access and FOIA staff who handle FOIA requests for such
archival records.

That office will assign your request a tracking number, and respond
directly to you. In the future, if you need to follow up with that office,
please contact them at the address below, or electronically via email
(email is preferred).

For your reference, a copy of your request is below.

Please visit our website at www.archives.gov/foia for further information
about making a FOIA request to NARA. On our main website, www.archives.gov,
you can learn more about the resources that we offer to the public, and you
can access our online catalog.

Due to the COVID-19 pandemic, and pursuant to guidance received from the
Office of Management and Budget (OMB), NARA had adjusted its normal
operations to balance the need of completing its mission-critical work
while also adhering to the recommended social distancing for the safety of
our staff. As a result of this re-prioritization of activities, you may
experience a delay in receiving a substantive response to your FOIA
request. We apologize for this inconvenience and appreciate your
understanding and patience.

Sincerely,

From: National Archives and Records Administration

Dear Andrew Kent:

I am writing in response to your Freedom of Information Act (FOIA) request
of August 9, 2023 for records in the custody of the National Archives and
Records Administration. Your request was received in this office on August
9, 2023 and assigned FOIA tracking number *RD 77658.*

You requested Department of Justice File Number 210956. The file folder was
located during the search. However, the contents of the folder were
consolidated by the agency and we are unable to locate the contents. As a
courtesy, I have included a digital copy of the file cover page. Since we
are unable to review the records, we were unable to determine if the
records were responsive to your request

Because we were unable to locate the contents in File 210956 in our
holdings, we are closing your request administratively. This concludes the
processing of your request.

If you are not satisfied with our action on this request, you have the
right to file an administrative appeal within ninety (90) calendar days
from the date of this letter. Appeals must be in writing and may be
delivered by regular U.S. mail or by email. By filing an appeal, you
preserve your rights under the Freedom of Information Act and present the
deciding agency with an opportunity to review your request and reconsider
its decision. If you submit your appeal by regular mail, it should be
addressed to the Deputy Archivist of the United States (ND), National
Archives and Records Administration, 8601 Adelphi Road, Room 4200, College
Park, Maryland 20740-6001. Both the letter and envelope should be clearly
marked “FOIA Appeal.” If you submit your appeal by email, please send it to
foia@nara.gov, addressed to the Deputy Archivist, with the words “FOIA
Appeal” in the subject line. Please be certain to explain why you believe
this response does not meet the requirements of the Freedom of Information
Act. All communications concerning this request should reference your FOIA
tracking number.

If you would like the opportunity to discuss our response and attempt to
resolve your dispute without initiating the appeals process, you may
