I would like these records in the electronic format that they are stored in, transmitted via email or other digital method; please refrain from sending paper copies of the records.

Rather than provide all responsive records at once, I ask that you provide copies of records on a rolling basis, as they become available.

If you determine that any of the information qualifies for an exemption from disclosure, I ask you to note whether the exemption is discretionary, and if so whether it is necessary in this case to exercise your discretion to withhold the information. In any event, please provide a signed notification citing the legal authorities on which you rely if you determine that any of the information is exempt and will not be disclosed.

And what is the cost estimate, if any, for this request?

Hello again. I'm hopeful that we can resolve this matter without seeking a judicial remedy through the courts, which Insider has done with other agencies in Alabama successfully before and is prepared to do again. I can only assume that your agency would rather avoid the cost and time associated with that resolution.

To get us closer to that, can you confirm your understanding that this request seeks copies of electronic records, as well as a cost estimate, if any, to provide them?

Good afternoon. When can I expect to receive records responsive to this now long-overdue request?

I’ve responded multiple times and would be glad to provide you the responses. As I have repeatedly indicated, the documents you request, even the revised request, are not kept in one form and require us to dedicate personnel to pull the records. Doing that pulls them away from their regular job. We have the right to request that you compensate us for that time. Once we get your commitment to compensate us for pulling the documents that you request, we will pull them and make them available for you to review. I estimate the cost to be approximately 2500 but your commitment would have to be to pay us any amounts over that necessary. By the same token, if it doesn’t that the amount of time I estimate, the amount you would have to pay would be lower.
