Pursuant to Michigan's Freedom of Information Act ("FOIA"), I hereby request the following records:

Annual recycling reports submitted for compliance for the Electronics Waste Takeback Program for 2013, 2014, 2015, and 2016 as well as any other documents that show compliance with the program. Any documents that list the specific e-waste recycling centers used by the following manufacturers to fulfill its manufacturer e-cycling obligations as well as the quantity and type of electronics that were recycled on the following manufacturers’ behalf. Any proposal or registration documents submitted by the following manufacturers between 2013 and the time this request is processed:

IBM
Dell
Samsung
Microsoft
LG
Sony
HP
HTC
Nintendo
Google

The requested documents will be made available to the general public, and this request is not being made for commercial purposes. They will be used in the course of reporting for Motherboard, VICE's science and tech site (www.motherboard.vice.com).

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Your request is granted in part and denied in part.

Partial Granting: All existing, non-exempt records responsive to your description of records were made available for your review or sent to you under separate cover.

Partial Denial: After a search for records, to the best of this public body’s knowledge, information, and belief, the public record(s) as described by you, or by another name or description reasonably known to the public body, do(es) not exist in our files; therefore, your request to examine or receive a copy of documents for the following site OR the following documents is denied:

We do not have any documents associated with HTC and Nintendo. They are not required to register under Part 173 of Act 451 as amended.

Under section 10 of the FOIA, the DEQ is obligated to inform you of the following:

1) You may appeal this decision in writing to the Director of Legal Services, Department of Environmental Quality, P.O. Box 30473, Lansing, Michigan 48909-7973. The writing must specifically state the word “appeal” and identify the basis for which the disclosure determination should be reversed. The Director of Legal Services, or her delegated designee, must respond to the appeal within 10 business days of its receipt. Under unusual circumstances, the time for response to the appeal may be extended by 10 business days.

2) You may commence a civil action in the Court of Claims within 180 days after the date of the final determination to deny the request. If you prevail in such an action, the court is to award reasonable attorney fees, costs, and disbursements, and possible damages.
