Pursuant to the Michigan Freedom of Information Act, I hereby request the following records:

Any and all written or electronic correspondence, including email attachments, sent or received by drinking water division director Eric Oswald that contain one or more of the following words or phrases: "Nestle Waters North America", "Nestle Waters" and/or "Nestle". This request pertains to communications sent or received between September 1, 2017 and the date this request is processed.

I am a reporter for The Nation and The Guardian, and the requested documents will be made available to the general public. This request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

This notice responds to your request for information received by the Department of Environmental Quality (DEQ) on March 21, 2018 under the Freedom of Information Act (FOIA), MCL 15.231 et seq. You requested information described as: Any and all written or electronic correspondence... sent or received by drinking water division director Eric Oswald... "Nestle Waters North America", "Nestle Waters" and/or "Nestle" ... September 1, 2017 and the date this is processed.

To determine the extent of responsive information, inquiry must be made of the appropriate division(s) of the DEQ. Therefore, it is necessary to extend the time for response, as permitted by section 5(2)(d) of the FOIA, MCL 15.235(2)(d), through 4/11/2018.

Good afternoon, Mr. Tobias.

Thank you for your inquiry. Per our April 10, 2018, notice, the Michigan Department of Environmental Quality (MDEQ) would complete the processing of your request within and estimated 10 business days, following payment (see attached). The MDEQ received payment notice on April 23, 2018, from its accounting department. As such, you should expect to hear from the MDEQ on or before May 7, 2018.

Good morning, Mr. Tobias.

The DEQ received notice of your payment on April 23, 2018, and the responding program area was notified to begin processing your request. In the department's April 10, 2018, notice, the DEQ informed you that upon payment, processing of the request would be complete within 10-business days. However, due to the volume of records identified during the processing of your request, it is taking the department longer than anticipated to examine, review, and delete/separate exempt from nonexempt information. As such, an extension is needed in order to complete the processing of your request. It is estimated that on or before May 21, 2018, that the DEQ will have completed the processing of your request; at which time it will send responsive records, the statutory basis for exemptions, if any, and the statutory remedial rights, if applicable.

Per our May 25, 2018, notice, responsive records were too large to email. Instead, records were placed at the previously identified online location for you to download or print. There are storage limits on that repository and due to the large volume of information that we deal with on a daily basis, information cannot be stored at that location indefinitely. Please send an email when you are prepared to access and download your records within a 48 hour timeframe and we will proceed with placing them back out there for you to grab.
