To whom it may concern:

Our office has recently received via facsimile inquiries regarding certain open record matters. These inquiries purportedly come from an entity identified as "MuckRock.com," and reference open records requests which have supposedly been made to our office. The inquiries seek "follow up" on the referenced requests which supposedly have been made some time in the past. We are sending this to the above email recipients seeking certain clarifying information.

1. The inquiries are being made by "MuckRock.com," but invoking requests supposedly made by named individuals. Yet the email addresses included in the inquiries all appear to be associated with "MuckRock.com" rather than the named individuals. Accordingly, if you are a recipient of this email, we ask that you verify whether or not you are the actual requestor who sought the information originally. If you are seeking the information on behalf of an entity other than yourself, please state your relationship to the entity and the capacity in which you are acting. Also, we would ask that you provide us with a distinctive email and/or mailing address to enable us direct communication with you.
2. Aside from the identity issues addressed above, please note our interpretation that these "follow up" inquiries appear to be seeking sequentially or revolving requests for information. Under the Open Records Act, we are not required to respond to such requests. However, if you are seeking a specific current record, you may clarify with a specific new request.

Sincerely,

Sterling Harmon,
Assistant Criminal District Attorney
