Studies or reports relating to terrorism insurance exclusion

To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:

Any and all studies or reports commissioned or utilized by the Office of the Governor to evaluate the pros/cons of changing the statute governing standard Massachusetts fire insurance policies to allow insurance companies to exclude fires caused by acts of terrorism.

The statute (part of MGL Part 1, Title XXII, Chapter 175, Section 99), which took effect April 13, 2011, reads as follows:

"Thirteenth, Notwithstanding any other provision of this chapter, a commercial policy issued in compliance with this section may exclude coverage for loss by fire or other perils insured against if the fire or other perils insured against were caused directly or indirectly by an act of terrorism; provided, however, that “an act of terrorism” shall have the meaning as defined in the Terrorism Risk Insurance Act of 2002 (P.L. 107-297), as amended. Exclusions under this clause shall remain valid and in effect until the expiration of the Terrorism Risk Insurance Program created by the Terrorism Risk Insurance Act of 2002, or its successor."

I also request that all fees be waived as I am a journalist -- employed by MuckRock and the Boston Globe -- and intend to use any pertinent information I receive as a result of this request to educate the public.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
